  2. Summary of Proposal: • Re-Segmentation: move lower Johnson Gulch to a new Segment 3h and maintaining remaining gulches in Segment 3b • Numeric Standards: • Segment 3h: Agriculture-based numeric standards • Segment 3b: Full suite of aquatic life standards • Site-specific Boron Standard • Segments 3h and 3b: 5.0 mg/L • Recreation: • Segments 3hand3b: Recreation P • Agriculture: • Segments 3hand3b: Agriculture classification • Use Protected: • Segment 3b

  3. Remaining Issues: • Appropriate numeric standards for Segment 3b • WQCD suggests a full suite of standards • WQCD and Trapper agree SSS boron standard of 4.0 mg/L • Trapper proposed agriculture based standardsbased on limited aquatic life and ephemeral drainages • MMI scores 6 – 38; Very limited fish populations • RPHS, Exhibit 2 Ute Gulch, September 2012 Middle Flume Gulch, June 2013 Coyote Gulch, July 2008 Johnson-Pyeatt Confluence,July 2009 Horse Gulch, June 2009 Deal Gulch, June 2013

  4. Iron temporary modification (if necessary) • Trapper Mining Inc. will initiate a pre-filtration study method of assessing the Fe standard in Segment 3b • A temporary modification of “current condition” with an expiration date of 12/31/2017 • Data will be collected for 2 – 3 years to assist in documenting instream conditions • Samples will be filtered instream with a coarse10 µm filter • Benthic invertebrate communities will be assessed annually to determine if particulate form of iron is an issue • Trapper will submit a study plan for review during the 2014 Temporary Modifications Hearing process
