  12. Regulatory Update

  13. Legal Framework • Telecommunications Act, Part IV.1 on Telecommunications Apparatus • New Telecommunications Apparatus Regulations (December 19, 2001, Canada Gazette Part II) • Radiocommunication Act • Amendment to Radiocommunication Regulations (December 19, 2001, Canada Gazette Part II)

  14. Radiocommunication Regulations Amendment • Changes made to Part III of Radiocommunication Regulations dealing with TAC and compliance with applicable standards • Recognition of certificates issued by: • recognized foreign CBs under the terms of an MRA • recognized Canadian CBs that meet the requirements set out in “Requirements for Certification Bodies” (CB-01)

  15. Market Surveillance and Enforcement

  16. Market Surveillance • Technical audits • Imports monitoring • Inspections and enforcement • Conformity Assessment Body reassessment and surveillance • Maintenance of a list of certified/ registered products for Canada by IC • Radio Equipment List • Terminal Equipment List

  17. Technical Audits • Ongoing testing of apparatus by IC • Random • In response to complaints • Also, Certification Bodies are required to audit apparatus they have certified

  18. Inspections and Enforcement • Verification of proper marking • Inspections to be conducted • Random & national in scope • based on complaints • May result in re-testing to technical specifications • Progressive enforcement measures and fines will be applied • Educate=>Notify=>Enforce

  19. CABs Reassessment and Surveillance • Testing Laboratories • Labs accredited by IC will be reassessed • Control visit after first year • Reassessment every two years • Labs accredited by other accreditation bodies(SCC, A2LA) will be reassessed as per their accreditation program • Certification Bodies • Regular reassessment as per accreditation program for CBs such as SCC’s annual reassessment • Audits of CABs by IC

  20. Imports Monitoring • Cooperation with Canada Customs and Revenue Agency (CCRA) • Transparent monitoring program focusing on importers with history of non-compliance • Trend analysis • Minimum impact on compliant importers and flow of goods at border • No impact on importers capability to participate in other CCRA programs • Capability to cover all IC regulated products

  21. Recognitionof Certification Bodies

  22. Definitions • Accreditation means procedures by which an authoritative body formally recognizes a body or person as competent to carry out specific tasks • Designation means the authorization by a Designating Authority of a Conformity Assessment Body (CAB) to perform conformity assessment Activities • Recognition means acceptance of a CAB by a regulatory authority

  23. CAB Type Activity Canadian CAB Foreign CAB Testing Laboratories Test to CS-03 (Spec for Terminal Equipment) • ACC-LAB for accreditation by IC; or accreditation by SCC or other recognized accrediting body • DES-LAB ; for recognition by IC REC-LAB ; for recognition by IC Test to foreign MRA partner requirements • ACC-LAB for accreditation by IC; or accreditation by SCC or other recognized accrediting body • DES-LAB ; for designation by IC X Certification Bodies Certify to IC Category I radio apparatus CB-01 - procedure for recognition by IC CB-02 - requirements for recognition by IC CB-03 - requirements for certification applicable to certificate holders REC-CB - procedure for recognition by IC CB-02 - requirements for recognition by IC CB-03 - requirements for certification applicable to certificate holders Certify to foreign MRA partner requirements DES-CB ; for designation by IC X Conformity Assessment Body (CAB) Procedures Roadmap

  24. Recognition of Certification Bodies • CB-01 “Requirements for Certification Bodies” (Canadian CBs only) • REC-CB “Procedure for the Recognition of Foreign Certification Bodies by Industry Canada” • CB-02 “Recognition Criteria, and Administrative and Operational Requirements Applicable to Certification Bodies for the Certification of Radio Apparatus to Industry Canada’s Standards and Specifications” • CB-03 “Requirements for the Certification of Radio Apparatus to Industry Canada’s Standards and Specifications”

  25. Recognition of Certification Bodies by IC • IC will recognize Certification Bodies (CBs) interested in certifying radio apparatus to IC’s requirements • Canadian CBs • Foreign CBs designated by an MRA partner

  26. Canadian Certification Bodies – IC Regulations Certification Accreditation by SCC or a recognized accreditation body Recognition by IC (CB-01, CB-02, CB-03) IC notifies CB of recognition

  27. Canadian Certification Bodies –Foreign Regulations Certification With MRAs (Phase II) Accreditation by SCC or a recognized accreditation body Designation by IC (DES-CB) Recognition by Foreign Authority IC notifies CB of recognition

  28. Foreign Certification Bodies With MRAs (Phase II) Accreditation/ Demonstration of competence Designation by Foreign Authority Recognition by IC (REC-CB, CB-02, CB-03) Foreign Authority Notifies Foreign CB of Recognition

  30. Testing LaboratoryProcedures

  31. Procedures REC-LAB – “Procedure for the Recognition of Designated Foreign Testing Laboratories by Industry Canada” DES-LAB – “Procedure for the Designation and Recognition of Canadian Testing Laboratories by Industry Canada” ACC-LAB – “Procedure for the Accreditation of Testing Laboratories by Industry Canada”

  32. Recognition of Foreign Test Labs (REC-LAB) • Procedure used by foreign designating authority • Foreign lab must be designated by an MRA partner • IC recognize designated testing lab • Testing lab authorized to test foreign terminal equipment to Canadian specifications

  33. Designation or Recognition of Canadian Testing Labs (DES-LAB) • Canadian testing labs may be recognized for testing of terminal equipment to IC standards • Canadian testing labs may be designated to foreign standards for terminal equipment, radio equipment and EMC

  34. Designation or Recognition of Canadian Testing Labs (DES-LAB) • Legally identifiable • Located in Canada • Designation may not exceed: • Scope of accreditation of the testing laboratory • Scope of the applicable MRA coverage

  35. Recognition by IC is not required for … • Testing laboratories for the testing of : • Radio apparatus • Interference Causing Equipment (Electromagnetic Compatibility requirements)

  36. Accreditation Requirements • ISO/IEC 17025 • For foreign testing laboratories, equivalence will be considered based on the terms of the MRAs

  37. Options for Accreditation AB: Accreditation Body Internal Preparation by Applicant (Establish Quality System) Accreditation by AB recognized by Foreign Regulatory Authority Accreditation by IC Accreditation by SCC or AB recognized by SCC Designation/Recognition Process

  38. Accreditation by IC • Accreditation may be granted by IC for telecommunications, radio equipment and EMC • May be used to satisfy accreditation requirements of DES-LAB and DC-01 • Permanent facility required • Accredited in accordance with ISO/IEC 17025. • Procedure for the Accreditation of Testing Laboratories by Industry Canada (ACC-LAB) • Similar to SCC accreditation (CAN-P-4)

  39. IC Accreditation (Cont’d) Applicant Set up of Internal System (ISO/IEC 17025) On-Site Audit Apply to IC Correct non- conformities Evaluation of Documents Accreditation Certificate Issued Correct non- conformities
