Navy Equal Opportunity Policy SECNAVINST 5350.16 Background • Everyone regardless of race, ethnicity, color, religion, gender or National origin, will be treated with dignity and respect. • The inability to overcome prejudices in the past has proved detrimental to our combat readiness and mission accomplishment.

  3. Navy Equal Opportunity Policy SECNAVINST 5350.16 Discrimination • Impedes/destroys our cohesiveness and morale • Is contrary to DON Core Values • Destroys members’ confidence and trust in their shipmates

  4. Navy Equal Opportunity Policy SECNAVINST 5350.16 DON Policy • Unlawful discrimination in any circumstance is prohibited and will not be tolerated.

Navy Equal Opportunity Policy SECNAVINST 5350.16 Assignment and Responsibility • Assistant Secretary of the Navy (Manpower & Reserve Affairs) is responsible for the overall execution, administration and supervision of the EO program. • CNO shall implement policy, training, and an annual Military EO Assessment .

Navy Equal Opportunity Policy SECNAVINST 5350.16 • COMMANDERs/COs/OICs • May not condone or ignore discrimination • Are responsible and accountable for enforcing policy against discrimination • Commanders or supervisors ensure personnel receive training annually. • Ensure mandatory comments made on FITREP/EVAL for member found guilty by NJP, court martial or competent jurisdiction

Navy Equal Opportunity Policy SECNAVINST 5350.16 • COMMANDERs/CO’s/OICs cont’d • Ensure personnel and families are treated fairly both on and off base (i.e. housing, restaurants) • Impose, through Armed Forces Disciplinary Control Board, off-limits sanctions in places of public accommodation that discriminate • Commanders or supervisors ensure personnel receive training annually. • Ensure mandatory comments made on FITREP/EVAL for member found guilty by NJP, court martial or competent jurisdiction

  8. Navy Equal Opportunity Policy SECNAVINST 5350.16 Your Responsibility • Ensure discrimination does not occur in any form or at any level • Make appropriate authorities aware of each violation of this policy.

Navy Equal Opportunity Policy SECNAVINST 5350.16 Complaint Process • CO’s must be informed immediately, usually within 24 hours, of any complaint. • Every reported incident, formal or informal, must be investigated to determine if case is substantiated or unsubstantiated. • Formal complaints of discrimination or sexual harassment must be reported by SITREP via the Special Incident Reporting System.

  10. Definitions and Terms • Affirmative Action – Processes, activities, and systems designed to prevent, identify, and eliminate unlawful discriminatory treatment as it affects the recruitment, training, assignment, utilization, promotion and retention of military personnel.

Terms Cont’d • Complaint – An allegation of unlawful discrimination based on race, ethnicity, color, national origin, religion, or sex. • Complainant – A service member who submits allegations of unlawful discrimination. • Informal Resolution System – A system for resolving EO complaints at lowest level within COC.

Terms Cont’d • Ethnic Group – A group socially distinguished or set apart by others and/or by itself, primarily on the basis of cultural or nationality. • National Origin – An individual’s or ancestor’s place of origin. • Religion – A personal set or institutional system of attitudes, moral or ethnic beliefs, and practices that are held with the strength of traditional religious viewed, characterized by ardor and faith, and generally evidenced through specific religious observances.

  13. Terms Cont’d • Reprisal – Taking or threatening an unfavorable personnel action or withholding or threatening to withhold a favorable personnel action, or any other act of retaliation, against a military member for making or preparing a protected communication.

  14. TYPES OF COMPLAINTS • Informal – Allegation of unlawful discrimination made either orally or in writing that is not submitted as a formal complaint. • Formal – Allegation of unlawful discrimination that is submitted in writing to the authority designated for receipt of such complaints in service implementing regulations.

  15. Complaint Processing • CO’s must be informed immediately, usually within 24 hours, of any allegation of unlawful discrimination or equal opportunity complaint in their command. • Formal Complaints must be reported by SITREP within 60 days of the incident via the Special Incident Reporting System.
