What is a GWAC? A Governmentwide Acquisition Contract is a task or delivery order contract for Information Technology (IT). • Contracts established by one agency for Governmentwide use • Operated by an Executive Agency designated by the OMB • Not subject to the Economy Act
Why use a GWAC? • IT services-based solutions that can include ancillary non-IT components if integral and necessary to accomplishing the IT solution • Quality pools of contractors • Full range of contract types • Pre-defined labor categories (offerors propose based on uniform set of definitions)
Why use a GWAC? continued • Streamlined acquisition process based on FAR 16.505 reduces procurement lead time • Orders not protestable up to $10M *(except for exceeding scope, period of performance and maximum dollar value of contract) • Access to quality customer service *As of May 27, 2008, Orders over $10M may be protested to GAO

Who Can Access a GWAC? • Warranted Contracting Officers * • Who receive GWAC training and • Obtain a Delegation of Procurement Authority (DPA) * Warranted Contracting Officer becomes Ordering Contracting Officer (OCO) after obtaining DPA
How to Access a GWAC • Direct Acquisition • Requesting Agency OCO conducts acquisition and administers Order • Assisted Acquisition • Servicing Agency OCO conducts acquisition and administers Order on behalf of Requesting Agency • Value Add Fee as agreed to between Procuring Agency (i.e. GSA Assisted Services) and the Requesting Agency
GWAC Center Responsibilities • Perform risk mitigation and contractor oversight • Pre-Award scope reviews conducted by GWAC Contracting Officers upon request • Email to: SOWreview@gsa.gov (scope review process posted on the website) • Provide client support • Expert resource in Basic Contract terms and conditions, ordering procedures, contracting and IT • Report annually to Office of Management and Budget (OMB)
GWAC Center Responsibilities • Monitor competition under Fair Opportunity • Review all task orders and modifications • Monitor subcontracting limitations • Conduct program meetings/reviews with Contractors • Perform closeout of GWACs • Develop business cases for new GWACs
VETS GWAC A result of Presidential Executive Order 13360, October 2004 • Veterans Technology Services (VETS) is a governmentwide contract for acquiring integrated information technology (IT) solutions worldwide from service-disabled veteran-owned business concerns. • The GWAC includes 43 highly-qualified contractors with competitively-awarded indefinite-delivery-indefinite-quantity (IDIQ) contracts in two functional areas.
VETS GWAC • Base performance period – February 2, 2007 to February 1, 2012 • Options – one 5-year option • Minimum order –Maximum order– none • Program ceiling for all contracts – $5 billion • Fair Opportunity
VETS GWAC: Scope • Two Functional Areas (FAs)*: • FA1 Systems Operations and Maintenance39 Contract Holders • FA2 Information Systems Engineering34 Contract Holders *Both functional areas include IT Security Services *Scope is outlined under Section C of the Contract

VETS GWAC: Task Order Types • Fixed-Price Family (preferred method) • Time and Material* • Ceiling rates • Labor Hour* • Ceiling rates • Hybrid • Combination of the above types * Require a written justification in accordance with FAR 16.601(d). * Ceiling rates for consistent labor categories provided
Ordering from VETS* • Get delegation of procurement authority thru training • Develop acquisition strategy (includes your selection of functional area) • Ensure that all task orders are for IT Services and Solutions • Issue RFI, RFQ or RFP to all contract holders in functional area • Applicable clauses may be added at task order level • The Center is available to assist with SOW review prior to release *Ordering procedures are outlined in Section G of the Contract, Ordering Guide available on-line.
Strategy Considerations • We recommend asking these questions about your IT requirement: • Is it services-based? • Is it within scope of the GWAC? • How do I find contractors that provide what I need? • What kind of pricing can I expect? • What value is there for my organization?
Ordering • Provide each contractor a Fair Opportunity to be considered for each order per FAR 16.505 • Document your process consistent with FAR 16.505 and customer agency policy • There are limited Fair Opportunity exceptions (FAR 16.505(b)(2))
Fair Opportunity Exceptions • Exceptions to Fair Opportunity - FAR 16.505(b)(2) (i) The agency need for the supplies or services are so urgent that providing fair opportunity would result in unacceptable delays; (ii) Only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized; (iii) The order must be issued on a sole-source basis in the interest of economy and efficiency as a logical follow-on to an order already issued under the contract, provided that all awardees were given a fair opportunity to be considered for the original order; or (iv) It is necessary to place an order to satisfy a minimum guarantee. (DFARS allows an additional exception at 216.505-70 (b) for a statute that requires purchase from a specified source.)
