Understanding the federal definitions as described in the Elementary and Secondary Education Act of 1965 (ESEA) for ELLs and IY students is essential to: Identifying these students in order to ensure they are provided full and equal access to the same curriculum and educational opportunities as all students Determining the Title III, Part A, allocations to school divisions based on an accurate count of ELLs and IY students. 16

Clarification on High School Exchange Students For students on J-1 (Exchange Visitor) visas and F1 (Exchange High School Student) visas, the standard identification, screening, and placement process must be followed as required by Title VI of the Civil Rights Act of 1964 to determine if the student is an ELL.  If a school division has followed this process and determined that the exchange student is not an ELL, this determination should be documented in the student’s educational record. 17

  15. Clarification on Immigrant Children and Youth (IY) The term “state” means each of the 50 states, the District of Columbia, and the Commonwealth of Puerto Rico. Therefore, students born in Puerto Rico are not considered immigrant. Students born in U.S. territories such as Guam, American Samoa, or the U.S. Virgin Islands, may be considered immigrant. ESEA, Section 3101(14) 18

Further Clarification on Immigrant Children and Youth (IY) The following students may be considered as IY if they meet all of the criteria in the federal definition of immigrant children and youth: Children of U.S. military personnel Children of NATO families Children of visiting faculty Children who are temporarily residing in the U.S. because of parental employment or for other reasons Students on Exchange Visitor (J-1) visas or Exchange High School Student (F-1) visas 19

  18. Re-designation as LEP Federal law allows for students to be re-designated as LEP. Prior to re-designating a formerly LEP student, interventions should have been consistently provided to the formerly LEP student for a reasonable period of time during which the student’s academic performance showed no improvement. The interventions should be the same as those available to all students at risk for academic failure. 21

Setting AMAO Targets Section 3122 of the ESEA requires that states set Title III AMAO targets to measure the annual increases of ELLs making progress in learning English and attaining English proficiency, as well as their achievement on content assessments for reading and mathematics. Currently, VDOE has set AMAO targets for AMAO 1 (Progress) and AMAO 2 (Proficiency) through the 2013 -2014 school year. VDOE has contracted with Gary Cook, senior researcher at WIDA, to: 1) analyze Virginia ACCESS for ELLs data for the 2011, 2012, and 2013 school years 2) recommend AMAO targets for five additional years beyond 2013-2014 36

Change to AMAO 3 Determinations VDOE has been notified by USED that states which received approval for the ESEA flexibility waiver must include the following elements when making AMAO 3 determinations: • whether the LEP subgroup met its AMOs for reading/language arts and mathematics; • whether the 95 percent participation rate requirement was met for both reading and mathematics; and • the state graduation rate if the division includes one or more high schools. These changes to AMAO 3 determinations will take effect for the 2014-2015 accountability results based on the 2013-2014 data. 37
