  1. Warm Up #1 • In response to public opinion polls revealing Americans’ ignorance of the Bill of Rights, one commentator argued that, “The less Americans know about freedoms, the more they are likely to erode without our notice.” Do you agree or disagree with this statement? Why? • Why have disagreements arisen over the meaning of the establishment clause? AND, explain the difference between the free exercise clause and the establishment clause.

  2. Warm Up #2 • How does freedom of expression contribute to individual liberty and good government? • What restrictions are placed on the first amendment (cite court cases that established these limitations)? Do you agree that there should be restrictions? Why or why not?

  3. Warm Up #3 Read and annotate the article from NY Times Strip Search of Girl Tests Limits of School Policy • Write a summary of the case and then describe whether or not you agree with the 9th Circuit Court’s Decision. Be sure to base your position on constitutional principles. • What powers should be given to law enforcement officers in order for them to be able to enforce the law?

  4. Warm Up #3 Continued… • How did the court rule? • What was their constitutional rationale? • Do you agree or disagree and why?

Notes: Woll #20 and Woll #21 Notes: Woll #20 and Woll #21 Warm Up #4 (A Day) Before writing an answer to this prompt, work with your table partner to identify what amendments in the Constitution address privacy. • Does the Constitution protect the right of privacy?  If so, what aspects of privacy receive protection? • Be specific and explain your rationale.

The following answers should be based on your Woll #24 notes and reading. • Explain the rationale Justice Stewart gives for why abortion is protected under the Constitution. Be sure to include a discussion of why he believes the 14th amendment protects this right. • Explain Justice Rehnquist's dissent. What arguments does he rely on to explain why abortion should be unconstitutional. • If you were a justice, would you have concurred or dissented with Justice Blackmun’s decision. Did his rationale make sense constitutionally?

  7. Warm Up #5 • What are the differences between equality of condition and equal protection of the laws? • Does inequality undermine the ideal of equality of rights? Explain your response.

  8. Warm Up #6 • Why did lawyers in Brown v. Board come before the Supreme Court a second time? • According to the Brown II decision, who has responsibility for developing plans to desegregate public schools? Why do you think the Court ruled that desegregation plans should proceed "with all deliberate speed?" What did that mean? • Is separate inherently unequal? How does a school like Preuss fit into this paradigm established by Brown v. Board?

  9. Warm Up #7 • Read the article A Few Good Men • Does requiring only males to register for the draft unconstitutionally discriminate against them? Should women also have to register for a draft number when they turn 18?

  10. Warm Up #8 • Read the article University of Michigan Affirmative Action Program • Do you agree with how the court ruled? What were the viewpoints of the two sides?
