  2. Defenses • Protection from something, something that protects, justification • No Crime Committed • No crime at all, misunderstanding • No intent, simply an accident

  3. More Defenses • Did not commit the crime • Alibi: Proof somewhere else • DNA: Prove not you • Act Excusable / Justifiable • Self-Defense • Being safe, but unavoidable

  4. Even More Defenses • Infancy • Under 7 • Intoxication • To drunk or high to have intent • Voluntary intoxication not a defense

  5. Insanity • Must understand act when committing it • If crazy after, cannot defend self, so trial postponed • If deemed Not Guilty by reason of insanity = mental institution

  6. Defenses If Committed Crime but, • Persuaded by law enforcement to do so • Entrapment • Did crime as a result of coercion or a threat • Duress • Had to in order to protect life • Necessity
