  2. Northwest Territory - 1787 • Confederation Congress • No less than 3 states, no more than 5 • Slavery Prohibited • Free Exercise of Religion granted • Habeas Corpus and trials by jury

Ohiogranted statehood in 1803 • Enabling Act of 1802 – Allowed Ohio to become a state; sets the precedent for statehood • February 19, 1803, President Jefferson signed the bill into law providing that Ohio "had become one of the United States of America," and that Federal law "shall have the same force and effect within the said State of Ohio, as elsewhere within the United States." • First Ohio General Assembly convenes in Chillicothe, Ohio March 1, 1803 – Ohio’s “birthday”

Our three(?)Constitutions • 1802 – Strong legislature in response to the strong armed tactics of territorial governor Arthur St. Clair • 1851 – referendum to change the Constitution, lessen legislatures power • 1912 – many progressive amendments added to the 1851 Constitution; some call it a “new” constitution (not REALLY new though)

  6. Ohio’s Current Constitution (1851/1912) • 18 Articles with well over 100 sections! (compared to the 7 articles in the US Constitution having a little over 20 total sections) • Article I is the “Bill of Rights” (21 Sections) • In a nutshell..….Ohio’s is much more detailed and much longer than the US Constitution

  7. “Highlights” of Ohio’s Bill of Rights (Article 1) • Many of the same rights in the US BOR are included as well as others: • Habeas Corpus • No imprisonment for debt • Victim’s rights • Eminent Domain • Wrongful death damages in civil court • Right to choose your own health care (2011)

  8. “Highlights” of the Ohio Constitution • Articles 2, 3, 4 establish three branches • Article 6 has 6 sections discussing education • Article 14 is in regards to OH livestock • Article 15 is entitled “Miscellaneous” and includes topics such as marriage, the lottery, and who is eligible to run for office in OH • Article 18’s 14 sections discuss local government and “home rule”
