  3. Background Vision • The TIC governmental policies seeks to contribute to Chile become a developed country, in the digital field, for its Bicentennial. The electronic signature contributes: • To have a State on line in service of their citizens, where Government, Parliament and Judiciary, contribute from their respective scopes to the digital development of the country. • To reach an electronic commerce, highly developed, and with a considerable number of enterprises connected to the network. As well, to reach a critical mass of TIC enterprises, that could be able to compete internationally.

  4. Background Legal Frame • Law 19.799, about electronic document, electronic signature and the service of certification for this signature. • Decreto Supremo 181, of 2002, of the Ministry of Economy.

Background The Law • It regulates the legal and the probatory value of the electronic document and the use of the electronic signaturein that document. • It aspires to become the angular stone of the electronic commerce, besides to stimulate the use of the TIC by the State, to generate confidence and to encourage the electronic commerce.

  6. Background Main principles of the law • Liberty in the services given. • Free competence. • Technological neutrality. • International compatibility. • Equivalence between electronic support and paper. • No alteration of the logic categories in the legal framework.

Background Scope of application of the law The people and the enterprises, publics and privates, can grant an celebrate acts and contracts in the same way, being valid and producing the same effects in the ones celebrated by writing and paper support. Types of signatures Electronic signature and advanced electronic signature.

Background Regulation • It regulates the certification and use of the electronic signature by people, enterprise and the Administration of the State, the benefit of the services of certification and the accreditation of the certifiers. • It seeks to obtain the implementation of the new categories created by Law 19.799.
