  2. The SARA Program • Superfund Amendments & Reauthorization Act (SARA) • Became law in 1986 • 40 CFR Parts 350-372 • Also Known As: “Emergency Planning & Community Right-to-know Act” (EPCRA)

  3. Tier II Reporting - Sec. 304, 311 & 312 • Applies to facilities that store chemicals in excess of threshold amounts • For 2006, Tier II reporters included - ~ 37 asphalt plants

  4. Tier II Reporting con. • Chemical Stored Above Certain Level called a Threshold Planning Quantity (TPQ) Must Be Reported • For Extremely Hazardous Substances (EHS’s), like Sulfuric Acid, TPQ is TPQ for that chemical or 500 lbs. (whichever is less)

  5. Tier II Reporting con. • If not an EHS, but requires an MSDS under OSHA regulations, TPQ is 10,000 lbs. • If subject to MSHA and not OSHA, don’t have to report

  6. Tier II Reporting - Sec. 304, 311 & 312 • Chemicals reported include: • rock / gravel • diesel, gasoline, oils • burner fuel • asphalt, AC10, AC20 • emulsifiers • recycled asphalt • thermal slide

  7. Tier II Reporting - Sec. 304, 311 & 312 • hydrochloric acid, • polymers • hydrated lime • sodium hydroxide • Ferric chloride

  9. Tier II Reporting con. • Tier II report required 90 days after a TPQ is exceeded for the first time • For subsequent years, Tier II report is due March 1st of the following year for previous calendar year

  10. Tier II Reporting con. • Reports Submitted to: - CDPHE SARA Program - Local Emergency Planning Committee (LEPC) - Local Fire Department

  11. Tier II Reporting con. • We prefer the federal Tier II form or Tier II Submit diskette/CD, but…. • If need to report, check with your LEPC/fire department on their requirements • We will accept other forms as long as they have the federally required information

  12. Tier II Reporting con. • Tier II’s Entered Into Database For P2 Fees • Data Reported to: - Colorado Emergency Planning Commission (CEPC) - Local Emergency Planning Committee (LEPC) - EPA

  13. Toxic Release Inventory (TRI)Section 313 • If Manufacture or Use Certain Chemicals Above Thresholds, Report Wastes And Releases to CDPHE And EPA • Reports by Internet to EPA also covers CDPHE • Data Also Entered Into SARA Database For P2 Fees

  14. Toxic Release Inventory (TRI)Section 313 • ~ 10 asphalt plants reported to TRI in 2006 • Lead, Nitrate, Benzo(G,H,I)perylene, Polycyclic Aromatic Hydrocarbons (PAC’s) typically reported

  15. SARA Program Activities • Reporting Assistance and Information to Regulated Facilities, Emergency Response Community, Citizens and Internal/External Government Agencies • SARA Data Entry • P2 Fee Computation & Billing • Data Analysis and Program Evaluation

  16. P2 Fees Program • ~$106,000/yr collected from facilities that report under SARA Title III (Tier II, TRI) • Originally supported P2 Grants, then 24-hour Spill Reporting Line, now mostly program support
