Overview of NPDES Programs • National Pollutant Discharge Elimination System • A system of regulating point sources of pollution to surface waters • Typical point sources include treated process water discharges from industry • What is a permit? • An agreement • A license • A stick • All of the above

  3. NPDES Storm Water Program • Phase I 1990 • Industrial • 11 Categories, including construction • Large and Medium MS4s • Medium: Population of 10,000-249,999 • Large: Population of 250,000 or more • Phase II 1998 • Small MS4s in Urban Areas So, is it the population or…..

  6. Stormwater is the Urban Connection • What is Urban? • Higher Population Density • May be cities, towns or sprawl

  7. The Bureau of Census • Released its 2010 Census in late 2011 • Some communities in Delaware that were not currently regulated grew in population, so that they now require permit coverage • “Urban Area”

  8. Phase I • 1990 • Large and Medium MS4s • Industrial Facilities • Intended to cover the larger source contributors Phase 2 • 1999 • Small MS4s in “Urban Areas” • Intended to more fully cover the urban contribution

  9. Industrial Storm Water Program • Standard Industrial Classification (SIC) Codes or “Activity Code” • Examples of Sectors (or Classes) of SIC Codes: • Sector D: Asphalt Paving • Sector J: Mineral Mining • Sector M: Automobile Salvage Yards • Sector P: Land Transportation and Warehousing

  10. Provisions Under the Industrial Storm Water Program • Limits on Eligibility to Discharge (e.g. TMDLs) • “No Exposure” Certification • SWPP/SWMP/SWPP&MP • Maps, drainage, outfalls, training… • Effluent Monitoring • Specific to SIC Code • Inspections

  11. Currently, DE holds permits for 362 Active Facilities • 103 of these are No Exposure Certified • The Industrial Storm Water Regulations are currently being revised.

  12. Current MS4s in Delaware • Phase I (Issued May 7, 2013) • New Castle County • DelDOT • Towns of Bellefonte, Elsmere and Newport • Cities of Delaware City, New Castle and Wilmington • Phase II (Issued ~2003) • City of Newark • Town of Middletown • Kent County DelDOT • City of Dover

Provisions of the MS4 Program • Intent • Authorized Discharges • 6 Minimum Components • Public Education and Outreach • Public Involvement and Participation • Illicit Discharge, Detection and Elimination • Construction Site Stormwater Runoff Control • Post-Construction Storm Water Management • Pollution Prevention and Good Housekeeping • For each Minimum Component: • BMPs, goals, timelines and responsible party

  14. Provisions of the MS4 Program Public Education and Outreach/Public Involvement and Participation For Example: • Proper use of fertilizers and pesticides • Public reporting of illicit discharges • Stream clean ups • Proper maintenance of BMPs • Public review of SWPP&MP

  15. Provisions of the MS4 Program Illicit Discharge, Detection and Elimination For Example: • Ordinances • Grass Clippings • Commercial Facilities • Mapping of all outfalls • Development of a program to detect and report all illicit discharges

Provisions of the MS4 Program Construction Site Stormwater Runoff Control • Requires the review and approval of Sediment and Stormwater Plans according to standards set within the current Delaware Sediment and Stormwater Regulations • Use and maintenance of BMPs Post-Construction Storm Water Management • Implement and enforce a program to address post construction stormwater runoff from new development and re-development projects

Provisions of the MS4 Program Pollution Prevention and Good Housekeeping For Example: • A plan for all facilities owned or operated by permittee (Public Works yards, parks, composting areas…) • A street cleaning program • A program to manage snow and ice, including salt storage and alternate deicing practices And there could be more….

  18. What’s NEW in the MS4 Business? 2010 National Census changes where the permits are required New “State of Delaware Phase II MS4 General Permit” almost ready for review!

  19. So, now comes the 2010 Census And Delaware has grown…. Census tracts Urban Areas vs. Urban Clusters
