CAP and Counter Drug • 1986 – US Congress authorized CAP to support law enforcement in the government’s “war on drugs”. • Assist Federal, State, and local law enforcement agencies fight to eliminate illicit drug use, production and sale in the United States, its territories and possessions. • Authorized under DOD directive and applicable Air Force directives (Statutory Authority)

  4. Authorized Missions • Marijuana Eradication Support • Airborne Reconnaissance of property • Marine Reconnaissance • Airport Reconnaissance • Airfield Photography • Airborne Video/Digital Photography and Imagery

  5. Authorized Missions (Cont’d) • Communications Support • Radar Evaluation • Aerial Familiarization of Law Enforcement Agents • Drug Demand Reduction • Transportation Missions (limited circumstances)

  6. Non-Authorized Missions • CAP may not: • Participate in arrest, search and seizure, stop and frisk, or interdiction of vessels, aircraft, or vehicles • Conduct surveillance or pursuit of individuals • Act as informants, undercover agents, or investigators • “Posse Comitatus Act” • $10,000 fine / 2 yrs in jail if violating this provision

  7. Liability • All missions are flown non-combat as an Air Force Mission • Covered under: • Federal Tort Claims Act • Federal Employee Workers Compensation Act

  8. Clearance Process • Submit CAPF 83 to CDO • Must be original with original signature • One page, double sided, typed or computer generated • Place your ES rating in upper right side of form • Send to CDO who verifies information, then signs

  9. Clearance Process • Wing Commander reviews, and signs • Application mailed to NHQ for processing • Screened by: • Drug Enforcement Agency (DEA) • Bureau of Immigration and Customs Enforcement (BICE) • This could take several weeks or more • If denied, there is NO appeal process.

  10. Clearance Process • Online orientation course: • Once application is on file at NHQ • https://tests.cap.af.mil/ops/cd_dl/test_page.cfm?Message=Ok • Once approved and completed the online course, you will be issued a 101CD. • Roster is main source of approval certification

Refresher Requirements • Every year • Must document 20 hours of continuing education • If I don’t have the documents, it does not exist • Every 2 years • Must retake the online refresher course • Every 4 years • Must complete a new CAPF 83 and be screened again. • Members are dropped from the program effective November if requirements are not met

How do you get your 20 hours? • Continuing Education • Completing online CD courses • Devising scenarios, teaching courses, processing paperwork • CD Training, Missions, • Performance of administrative duties • Documentation submitted to CDO • Should be submitted to CDO NLT last day of the month.

  13. What is applicable to CD? • CAPF 5 – All applicable • CAPF 91 – All applicable • Proficiency – CAPR 60-1 • Attachment 9-1, 9-2, 9-4, 9-5, 9-6 • No electronic proficiency

  14. What is applicable to CD? • Must send copy of Form 5 or 91 as applicable • All must also include CAPF 104 (“CD Proficiency in Objectives”) • Complete CAPF 84 with all information completed • Do not forget your ADMIN time

  15. How to be “Decertified” • Making false or misleading statements on initial screening CAPF 83 • Failure to comply with the CAP Counterdrug Mission Nondisclosure Agreement • Compromising a CD mission or LE case • At the request of a CD agency

How to be “Decertified” • Violating or compromising a CAP, FAA, or supporting LEA regulation or policy • Statement or action causing question of personal integrity • Safety violation on a CD mission • Violation of the “Posse Comitatus Act” • Conviction of a criminal offense • Suspension if arrested in connection with a criminal offense

  17. If Decertified • All notifications will be done in writing • WG/CDO notified by HQ CAP/LMMC • CDO will notify WG/CC and the member involved • Copy maintained in files • CAPF 101CD will be revoked

  18. CD Eligibility • Privilege, not a right!!! • Qualifications: • CAP Senior Member, at least 21 years old • Cadets can participate in DDR • Minimum of 2 yrs in CAP • Cadet time can count towards this requirement • CD Applicable ES Rating • Mission Pilot, Observer, or Scanner

CD Positions • Incident Manager (IM) • Same as Incident Commander, but for CD • Must be a 101 rated IC • Verified by MDWG/DOS • Must be appointed in writing by Wing CC • Mission Pilot • Must have 101 card for MP • Verified by MDWG/DOS • Mission Observer • Must have 101 card for MO • Verified by MDWG/DOS

  20. Crew Qualifications • PIC • Transport – Must be Commercially rated • Over Water – Have completed a water survival course (Stay Tuned) • Mountains – Be Mountain qualified (Stay Tuned) • Twin Engine – Have 500 hours in twin aircraft • Comm. Rating and IFR for transport flights **

  21. Crew Qualifications • Observer/Scanner • Over Water – Have completed a water survival course • Special Purpose Missions: • SDIS, IR, Video/Scanning, Airfield Photo • Specific training on equipment utilized

  22. CAP Personnel • Maryland Wing – 48 members (as of today) • Of the 48, 34 are complete the process • Of the 14 remaining: • 11 waiting for screening clearance • 3 need to take the online course • MDWG will be supplemented by MER folks residing here in MD

  23. CAP Personnel • Maryland Wing • Mission Directors – 6 • Includes pilots and observers who are IC qual. • Mission Pilots – 22 • Includes Observers and IC’s who are MP qual. • Mission Observers – 48 • Counting also those qualified as Pilots and IC’s who are MO qual.

  25. Mission Coordination • Requests made to NOC from the Federal Law Enforcement Agency (LEA) • Local jurisdictions must coordinate through a Federal LEA • All CD missions will be approved by CAP/XO via National Operations Center • Force Protection • CAP will not be placed in harmful situations

  26. Uniform • Appropriate CAP uniform IAW CAPM 39-1 • NOC may waive this requirement if requested by the agency. • This will be justified in the mission request.

  27. Subpoenas • Members may receive subpoenas, orders or other requests for appearance or testimony; may also receive requests to produce or release “official information” regarding our support for the CD program. • Immediately notify MDWG CDO who will contact MER/CDO and NHQ/GC • YOU WILL NOT DISCLOSE ANY INFORMATION WITHOUT APPROVAL OF CAP/GC.

  28. Response for Media Requests • “This is a Civil Air Patrol flight crew performing an Air Force-assigned mission. They are not authorized to discuss operational details of the mission.   29. Funding • Non-CD appropriated funding can not be used for CD activities. • CD appropriated funding can not be used for non-CD activities. • $3,000 for FY-06 in MDWG

  31. Operational Requirements • Brief using landline vs. cell phone • Maintain radio contact with aircraft if possible • FAA Flight Plan • All CD Missions • Even if less than 50 nm • Except for enroute legs, all flights VMC

Operational Requirements • No explosives on aircraft • Pyrotechnic excluded • LE Officers may carry weapons on aircraft • CAP members who are LE may not • Avoid any possible conflict of interest • Ground Teams & Cadets • Not permitted on CD missions or in any capacity supporting CD missions (i.e. flight line, communications, etc)

  33. Operational Requirements • Aircrews will not direct LE officers or aircraft: • Drug activities (suspected) • Grow sites • Drug storage areas • Prisoners or informants will not be transported via CAP aircraft

  34. Operational Requirements • Overnight Stay • Must be requested initially • Requested by LEA • Overnight is more cost effective • Weather • Mechanical problems with the a/c • Exceeding your duty day • Mission requires it

  35. Paperwork • PIC closes CAP and FAA flight plans • Contacts FRO to close release • During a mission, results reported to LEA • After mission, aircrew completes the F 84 • CAPF 84’s to CDO • CDO will send to NOC within 72 hours • PIC submit 108 with 84 to CDO • Wing HQ retains 84’s for 7 years

  36. CD Equipment • Equipment purchased with CD funds is the property of the CD program • May be used for other meaningful purposes • CD Program has priority • Wing CDO must keep records and maintain all CD equipment

CD Forms (to be covered more 6/24) • CAPF 82 – CD Monthly Activity Report • Compiled by MDWG/CDO using data supplied from CAPF 84’s • CAPF83 – Application for CD approval • You should be familiar with this form by now • CAPF 84 – CD Mission Flight Plan/Briefing form • All CD aircrews should have several of these handy • CAPF 108 – CAP Payment/Reimbursement

Training Scheduled • 6 May 06 – Orientation Training (Today) • Welcomes all members to the MDWG CD Program • 24 Jun 06 – CD Spotter Course • Introduces the CD observer on how to properly spot suspicious growth from the air • Consists of classroom and flight component • Location: Martin State Airport, Time: 0900 hours • Funding already set aside

Training Scheduled (Cont’d) • CAPR 60-6 requires all members who conduct CD operations over water to have water survival training • Jul 06 – Water Survival Course for select members who will be trained and certified by the USAF Life Support Squadron to provide this training • Training for remaining members TBA • This date is subject to change • Primary audience: CD Members • Secondary audience: MDWG ES Aircrew members

  43. Training Scheduled (Cont’d) • 19 Aug 06 – Fundamentals of Aerial Photography for CD Observers • Course designed to teach the fundamentals of aerial photography and how to take meaningful pictures with SDIS • Location and Time TBD

Training Scheduled (Cont’d) • 20-22 Oct 06 – Fundamentals of Mountain Flying for the CD Mission Pilot • CAPR 60-6 requires any CD pilots who operate in the mountains to be Mountain qualified. • Course to be held in Cumberland • Time: 1800 Fri, 0900 Sat and Sun • Ground and Flight Components • Renew every 2 years

  45. Why do the training? • Currently talking to various agencies about employing CAP assistance: • Maryland State Police • US Army • MD Dept. of Transportation • Bay and Bridge Patrol = Homeland Security?? • Local LE agencies • Carroll County, Frederick County, Baltimore County
