IACS EWS Review • 2006 Tripartite – IACS reported: • What has triggered the review of Procedural Requirement 2 on EWS • Technical discussion on revision of PR2 (2007 status - 95% complete) • Challenges in implementing PR2 – confidentiality of ship specific information (2007 status – under revision)

IACS EWS Review • 2006 Tripartite – IACS reported: “Confidentiality” aspect on the Scheme: "Notwithstanding the general duty of confidentiality owed to its clients, clients hereby accept that [IACS Member] will participate fully in IACS' Early Warning System which requires each IACS member to provide its fellow IACS members with information on serious ship failures and engine room fires and explosions and equipment failures, including the name of the ship and its IMO number, to enable such useful information to be shared and utilised to facilitate the proper working of IACS' Early Warning System (which is aimed at enabling (i) "sister" or similar ships to avoid similar problems and (ii) the shipping industry generally to learn from failures and mistakes)."

IACS EWS Review • 2006 Tripartite – IACS invited… …Organisations present at the Tripartite meeting to support these efforts through their members’: - positive consideration of the Rule change aimed at addressing confidentiality issues, - direct cooperation in controlled (within the Scheme) sharing of damage information

  5. IACS EWS Review Industry response: • INTERTANKO Council approved its support for the clause. • HKSOA supported the revision and the clause.

  6. IACS EWS Review Responses from Governance Bodies of IACS Members: • Technical Committees of 2 Members agreed to incorporate the clause in their Rules/Regulations – done. • Technical Committees of 2 Members did not approve incorporation of the clause which would permit disclosure of “ship’s name and IMO number” – not incorporated. • IACS Council (June 2007) agreed to remove reference to “ship’s name and IMO number” from the clause and resubmit it to Members’ TCs.

IACS EWS Review New clause for consideration by Members’ TCs: Notwithstanding the general duty of confidentiality owed by [insert IACS Member’s or Associate’s name] to its clients [in clause xyz above], [insert IACS Member's name or Associate’s name] clients hereby accept that [insert IACS Member's name or Associate’s name] will participate  in IACS' Early Warning System which requires each IACS Member and Associate to provide its fellow IACS Members and Associates with relevant technical information on serious hull structural and engineering systems failures, to enable such useful information to be shared and utilised to facilitate the proper working of IACS' Early Warning System
