  2. Disclaimer Nothing herein is intended to supersede any provision of the Commission's rules or public notices. These slides should not be used as a substitute for an applicant's review of the Commission's relevant orders, rules, and public notices. Applicants must familiarize themselves thoroughly and remain current with the Commission's rules relating to the low power television, television translator, and Class A television broadcast rules relating to application and auction procedures, and the procedures, terms and conditions contained in the Auction 85 public notices.

  3. Closing Public Notice(FedEx Mailing) • Released approx. 2-3 business days after the auction closes • Includes: • List of winning bidders and bid amounts for each permit • Payments owed by each bidder and/or refunds due • Instructions for when and how to make down payments and file FCC Form 301-CA or 346

  4. SOLD! What happens next? • Down payments must be on deposit within 10 business days after the release of the Closing Public Notice. • Final payments must be on deposit within 20 business days after the release of the Closing Public Notice. • Within 30 calendar days after the release of the Closing Public Notice FCC Form 301-CA or 346 must be filed electronically. • If you are late in filing your long form application, you become subject to default payments.

  5. Down Payments • Must have on deposit with the FCC sufficient funds to cover 20% of net amount of winning bid(s). • Due within 10 business days of Closing PN release. • If applicable, a partially completed copy of the FCC Form 159 will be sent to winning bidders.

  6. Final Payments • Must have on deposit with the FCC sufficient funds to cover the balance of the net amount of its winning bid(s). • Due within 20 business days after the release of the Closing Public Notice. • If applicable, a partially completed copy of the FCC Form 159 will be sent to winning bidders.

  7. Method of Payment • Wire Transfer only • Fax FCC Form 159 to U.S. Bank at least one hour before sending wire transfer • Must use same FCC Registration Number (FRN) used on Form 175

FCC Form 301-CA or 346 – Applications for Broadcast Construction Permit • Submit a Form 301-CA or 346 for each digital proposal for which you are winning bidder • File Form 301-CA or 346 electronically through Media Bureau CDBS electronic filing system • CDBS URL: http://svartifoss2.fcc.gov/prod/cdbs/forms/prod/cdbs_ef.htm • Commission registration system (CORES) URL: https://svartifoss2.fcc.gov/coresWeb/publicHome.do

  11. FEES • There is no application filing fee for these minor change proposals.

  12. Required Exhibits Section 73.5005(a) of the Commission’s rules requires that post auction long-form applications include the exhibits mandated by: • Section 1.2107(d) (providing a detailed explanation of the terms, conditions, and parties involved in any bidding consortium, joint venture, partnership, or other agreement or arrangement the applicant had entered into relating to the competitive bidding process); • Section 1.2110(j) (requiring an applicant claiming designated entity status to describe how it satisfies the eligibility requirements for such designated entity status, and to list and summarize all agreements that affect designated entity status, such as partnership agreements, shareholder agreements, management agreements, and any other agreements, including oral agreements, that establish that the designated entity will have both de facto and de jure control of the entity); and • Section 1.2112(a) (requiring that each long-form application fully disclose ownership information and the real party or parties in interest in the applicant or application).

  13. Accepted for Filing Public Notice • Released by Media Bureau during course of long-form review. • Triggers the fifteen day Petition to Deny period

  14. Grant Public Notice • Will use CDBS “Broadcast Actions” public notices, listing application as granted. • Permit is mailed to permittee’s address. • Three year construction period.
