  2. DL Fees: CC Previous Authority Cited • 1009.23 (12) FS - laboratory fees - facilities or equipment use • Rule 6A-14.054 (6) Student Fees – allows each board of trustees to establish user fees for services that incur unusual costs

DL Fees - SUS Previous Authority Cited • S. 1009.24  (13) (k), F.S. -  Each university board of trustees is authorized to establish “A fee for off-campus course offerings when the location results in specific, identifiable increased costs to the university.” • 6C-8.002 Continuing Education - The Auxiliary Budget Entity may be used for the recovery of any additional fees established by the president for off-campus credit courses… Any fees …shall be established solely for the purpose of recovering all increased costs which result from offering these courses … • 6C-7.003 Special Fees, Fines and Penalties - The Board may authorize additional fees in order to meet specific higher education needs of the State when special circumstances result in specific, identifiable increased costs to a university… Each university president is authorized to establish fees for off-campus course offerings when the location results in specific, identifiable increased costs to the university.

DL Fees - Authority • Only those fees specifically authorized in statute can be assessed. • New fees cannot by created by the SBE, the BOG, or local Boards of Trustees unless they are authorized in statute • Rule can only be used to implement fees authorized in statute. • Previous to HB7105 - no statutory authority existed to assess a distance learning fee • Currently no authority appears to exist for assessing a hybrid fee

HB 7105 - CC Language changes • laboratory fees, which do not apply to a distance learning course • Such user fees and fines shall not exceed the cost of the services provided and shall only be charged to persons receiving the service. • A community college may not charge any fee except as authorized by law or rules of the State Board of Education.

  6. DL Fees - HB 7105 • Authority for DL Fees is provided • …. may assess a student who enrolls in a course listed in the Florida Higher Education Distance Learning Catalog established pursuant to s. 1004.09 a per-credit-hour distance learning course user fee.

DL Fees - HB 7105 • The amount of the distance learning course user fee may not exceed the additional costs of the services provided which are attributable to the development and delivery of the distance learning course. • the institution may not assess any other fees to cover the additional costs.

  8. HB 7105 - SUS Fees Language • No reporting requirement for SUS • “Fees” instead of “user fees” • “duplicative” fees (phrase difference)

What is a distance learning course? • Task Force will study - until then… • Current elements • 75% or greater of instruction • Hybrids are a problem • There is no statutory language to support a hybrid fee • Current reporting is unclear or exclusionary • They include substantial face to face time • They were considered in some discussions as covered by the general technology fee • They are not included in the catalog

DL Fees -Calculation • Questions were raised about round number fees and amount variations across the systems that might be in excess of the actual costs • There could be general and specific DL fees • All “additional” costs should be wrapped up in calculating the DL fee • Assessment or other specific exceptions • Fees must only be assessed to users of the resource or course

  13. Now What? • Chancellors will appoint the task force members • Catalog fields and data functions will be augmented as much as possible • DL fee notes will be distributed • Study outlines will be drafted • The Consortium will be a critical player in all of these activities • Special committees will likely be needed within and external to the membership
