  4. Controversy + Public Response • Daniel Ellsberg - disclose and publish to Nixon Cabinet • none interested • in response- 1971 gave Neil Sheehan NY Times 47 volumes • Protests + Political Controversy + Lawsuits • Beacon Press Senator Mike Gravel • Not unlawful, Freedom of Speech, Gravel v. US

Lawsuit • NY Times legal advise pre pub- Lord Day & Lord • James Goodale- 1st Amendment • Nixon ok, dissed Kennedy+ Johnson, advisors opposed b/c prevented future secrets • Ellsberg and Russo- Treason, Espionage Act 1917(felony) • Washington Post • “its decision did not void the Espionage Act or give the press unlimited freedom to publish classified documents. Ellsberg and Russo were not acquitted of violating the Espionage Act; they were freed due to a mistrial from irregularities in the government's case”
