Consumer Protection Act 2019 Upsc Who is Consumer A consumer is defined as a person who buys any good or avails a service for a consideration. It does not include a person who obtains a good for resale or a good or service for commercial purpose. It covers transactions through all modes including offline, and online through electronic means, teleshopping, multi-level marketing or direct selling. What is the Consumer Protection Act The Consumer Protection Act, implemented in 1986, gives easy and fast compensation to consumer grievances. It safeguards and encourages consumers to speak against insufficiency and flaws in goods and services. If traders and manufacturers practice any illegal trade, this act protects their rights as a consumer. Consumer has been defined legally in Sec 2(d) of the Consumer protection Act,1986. In general terms, a consumer is someone who acquires goods or services by paying for the same for their direct use or ownership rather than for resale or use in production & manufacturing.
The Act provides three-tier forum for redressal of consumer’s grievances, ● Firstly, the District Forum at district level, ● Secondly, the State Forum at State level and it is called the State Commission and, ● Thirdly, the National Commission at the National Level. Existing Rights Of Consumers In India Consumer Protection Act, the rights of consumers are as follows: ● Right to Choose: Consumers have the right to choose from different products or services at competitive prices. ● Right to Safety: Consumers have the right to be protected from any hazardous or adulterated products. ● Right to Seek Redressal: Consumers also have the right to file a consumer complaint against the seller or service provider and seek redressal of their grievance. ● Right to be Informed: The consumers have the right to get all the information about the ingredients used, quality and quantity of the product they are buying. ● Right to be Heard: Consumers have the right to approach a consumer court to voice their complaint and be heard equally. ● Right to Consumer Education: Consumers are also entitled to get all the knowledge of their rights and liabilities of service providers or sellers.
