Facts • October 16, 1976, BOE brought three charges against Barcheski • On August 10, 1976, Barcheski invites two female members of his driver education class to a party • The two female students attended the party and drank beer and smoked pot in Mr. Barcheski’s presence • Barcheski drove one of the female students home and had sexual intercourse with her in his automobile
Judgment • After review of the tenure commission’s records… The Circuit Court affirmed that the tenure commission’s ruling that the petitioner be discharged was BASED ON RESONABLE AND JUST CAUSE! AFFIRMED
