  2. Morals vs. Ethics • Very, very similar. One slight difference. • Morals: personal principles of right and wrong behavior • Ethics: established set of principles that govern a person’s or group’s behaviors • In other words: morals are personal opinions, while ethics are usually written morals that an organization agrees on.

  3. Attorney-Client Privilege • Protects most of the information the client gives the attorney during the course of representation.

  4. State Bar Associations • Organizations that represent all lawyers in a state. • Main Functions: • Administer the bar exam • Regulate legal education • Publishing journals • Providing access to legal services • Discipline attorneys for ethical violations

  5. Code of Professional Responsibility • Established by the American Bar Association • Code of ethics that consists of NINE canons (principles), which involve ethical considerations and disciplinary rules.

  6. Violation of Code • Lawyers who violate standards of conduct can be punished, suspended, or permanently disbarred by the state bar.

  7. Legal Malpractice • Professional or ethical misconduct committed by a lawyer. • Attorneys CAN be sued by their clients for serious errors that result in injuries or losses. • HOWEVER, some lawyers are unwilling to file malpractice suits against their colleagues.
