  1. The Eight Major Types of Unfair Dismissals Faced by Employees

  2. A company works on ethical grounds to make sure its customers get the best services and products. There are high chances of employees getting neglected in the process due to work pressure and complex job roles. While employees struggle with serving requirements under the sound principles of working, some professionals suffer the brunt of unfairness at work. There are different reasons why an organisation may let go of the employee. The reasons attributed are based on performance after giving opportunities to improve, unethical practices, or unwillingness to follow the company’s regulations.

  3. However, what happens when an employee is suspicious of how they have been removed from the company? This questionable act of dismissal may relate to reasons of an underlying issue or rivalry with the employer. In such cases, there are recognised boards in Melbourne that deal with empowering employees and their rights. Dealing with an unfair dismissal Here are some reasons that can lead an employee to become redundant by means unjustified. These factors allow the working professional to file for an Unfair Dismissal Claim.

  4. You were unlawfully dismissed because you did not agree to work beyond office hours.  • You were bullied because you complained about a colleague or reporting manager. • You refused to work under conditions that were not safe for you. • If the company suggests an alleged redundancy, but in reality, there was no redundancy.  • Suppose the employee faced discrimination due to several factors. The factors include race, colour, gender, sexual orientation, age, physical or mental disability, marital status, family or carer’s responsibilities, pregnancy, religion, political opinion, nationality or social origin. • Dismissed based on poor performance but without giving relevant opportunities to improve. • Terminated without any reason whatsoever that the employer does not find it relevant to reveal. • Blaming the employee for misconduct that they did not commit but have been framed accordingly.

  5. Dismissals that you cannot claim as unfair You may apply for unfair dismissal in Melbourne only if you can provide evidence for the same. Without evidence, the case you present may not be as solid as required to deliver justice.  It would be best to understand a fair dismissal from an unfair one. Only in knowing can you decide to implicate an organisation. This knowledge should allow you to think from a reasonable perspective as some organisations do act justly. However, only a few dismissals are conducted in a pleasant environment. A dismissal is considered fair when the employee’s job role is now redundant. However, the organisation cannot simply dismiss you due to redundancy. They will have to provide the means or opportunity for you to get hired at another company. Until then, you cannot be dismissed from the job, or your payment stopped.

  6. It can also relate to the employee’s conduct, skills and qualifications. If you were given ample time and opportunities to improve on your skills but failed to do so, the company has the right to provide you with forewarning and then dismissed you at the appropriate time. • Among unfair dismissal services, we offer the following: • Unfair Dismissal Legal Advice • Unfair Dismissal Redundancy • Unfair Dismissal Compensation • Unfair Dismissal Claim • Workplace Disputes • No Win No Pay Employment • Unfair Dismissal Lawyer • You may contact us to know more about how we can serve your needs best.
