  2. The law prohibits discrimination on the basis of sex in: • Admissions • Recruitment • Educational Programs • Housing • Access to course offerings • Comparable facilities • Counseling and Assessment • Financial Assistance • Employment Assistance

  3. and Athletics • Equipment and supplies • Games and practice time • Travel and per diem allowance • Coaching and tutoring • Assignment and compensation of coaches • Provision of locker rooms • Medical and training facilities • Housing and dining facilities • Publicity

  5. What the “Dear Colleague” Letter says: • Title IX prohibits discrimination on the basis of sex in education programs or activities • Sexual harassment of students is a form of sex discrimination • Sexual violence is an extreme form of harassment

  6. OCR Requires: • A designated coordinator • Notification for all students and employees • Prompt investigation of all complaints

  7. We must: • Investigate all complaints preliminarily • Pursue appropriate initial remedies or accommodations • Formal investigation if there are repeat offenses, patterns, predation, and/or future violence • Apply remedies while safeguarding victim privacy • Breach victim privacy only when formal resolution and comprehensive investigation are necessary.

  8. The law covers: Student-involved: • gender discrimination • sexual harassment • sexual assault and violence • retaliation • athletics equity • incidents on and off campus • cyber-bullying, if sex-based
