What the “Dear Colleague” Letter says: • Title IX prohibits discrimination on the basis of sex in education programs or activities • Sexual harassment of students is a form of sex discrimination • Sexual violence is an extreme form of harassment
OCR Requires: • A designated coordinator • Notification for all students and employees • Prompt investigation of all complaints
We must: • Investigate all complaints preliminarily • Pursue appropriate initial remedies or accommodations • Formal investigation if there are repeat offenses, patterns, predation, and/or future violence • Apply remedies while safeguarding victim privacy • Breach victim privacy only when formal resolution and comprehensive investigation are necessary.
