Accidents in Schools • There were 50,000 accidents reported to HSE from secondary and primary schools in the five years between 2005 and 2010. • Followed by 29 prosecutions of schools • Only 2 prosecutions concerning school trips. Schools are one of the safest places to be in the UK ! www.handsam.co.uk

Health and Safety Law LAW and GUIDANCE APPLYING TO ACADEMIES? • Health and Safety at Work Act (1974) • Regulations – e.g. COSHH, RIDDOR, PUWER, DSE • HSE Approved Codes of Practice • Department for Education advice - July 2011 • Many other items – ask yourself: ‘how do I know everything I need to know, about all of these when there is no LA to advise me, and how do I keep up to date?’ www.handsam.co.uk

  7. How does the Law Apply to YOU? • Is it the same as when you were within a Local Authority? • Yes • - and No! • The same law applies. • But now YOU are the employer if you are a stand-alone academy. • The Trust (whatever its status) is the employer if you join a group. www.handsam.co.uk

What does this mean for YOU? • You are responsible for all Health & Safety issues. • You need robust management processes and systems. • You need to be proactive not reactive. • You need regular checking, monitoring and questioning. • You need regular programmes of staff training. • You need to keep full records – a transparent audit trail. • You need access to advice from education sector experts. • This may well mean a readjustment of how your budget needs to be allocated - from the moment you convert. • You need to take this very seriously – getting it wrong is an awful experience. www.handsam.co.uk
