  3. Offences againstproperty Exam Technique

  4. Lesson Objectives • I will be able to draw the relevant information from an exam question • I will be able to structure an answer correctly • I will be able to apply this to a given scenario

  5. This lesson • We will go through a step by step guide on how to approach a question for your Unit 4 exam • You have a template split into 6 sections to help you • If you see anything highlighted in red, please copy this onto your template in the relevant section • Leave room to do what this guide asks you

  6. Point 1: How much time do you have/how many marks? • Your exam will last 2 hours • You have a choice of 2 questions, each of which are made up of 2 parts • You will then answer a third essay based question • Each of the first 2 parts are worth 25 marks • The final question is worth 30 marks (there are 5 additional AO3 marks available) • The first 2 parts are scenario based and the third is essay based • So you have 120 minutes to gain 80 marks • That equals roughly 1.5 minutes per mark, giving you plenty of thinking time

  7. Point 1: How much time do you have/how many marks? • So you have 40 minutes per question • Your evaluation question won’t require as much thinking time (5 minutes to make a plan) • Give yourself 7 minutes to plan each scenario question • In these 7 minutes you need to read the question twice, identify the main issues, identify what points of law are relevant, identify your cases and create a structure

  8. Point 2: Read it through thoroughly • Make sure you read through and understand the scenario • Read it through twice to be certain • Highlight any key points • Make quick notes if you need to Read through the question twice, I will time you, you have 2 minutes

  9. Point 3: What are the ‘Head Line Issues’? • Look at what the question is asking • Write down the 2-4 big talking points ( I doubt there will be more in each question) • These are points that will lead to discussion  discussion leads to marks  marks lead to a happy student! Make a note of the ‘headlines’ – you have 30 seconds

  10. Point 4: What are the points I need to talk about? • This is where you write down your main arguments and points to include • E.g. If a your headline is theft, you will need to discuss the actus reus and mens rea • Remember, don’t include things that are not needed • E.g. If no defence is mentioned, don’t apply it (if you’re slightly unsure, pay it lip service) • Remember, it is your application you are marked for, law is full of grey areas You have 2 minutes

  11. Point 5: What cases and Acts do I need to mention? • This is important because everyone has mind ‘blanks’ • Get it down quickly as not to panic yourself • An examiner told me years are more important with Acts and not cases • You don’t need to explain the facts of the cases, just reference them You have 1 minute (I appreciate your case knowledge may be a little sketchy here)

  12. Point 6: How will I structure this? • Draw a quick plan of how you plan to work through the question • It doesn’t need to be too detailed as the rest of your notes will aid you here • Put small headings and arrows with abbreviated case names You have 1.5 minutes

  13. Now it is your turn You have 7 minutes to read through and create a small plan for the following exam question.

  14. Several days later, Ken visited a bar and sat at the table next to Toby. After Ken had drunk several lagers and after Toby had left the bar, Ken picked up off the floor Toby’s bank card which had fallen out of his pocket. Ken memorised the details on the card before handing it in to the owner of the bar. On returning home, Ken used Toby’s card details to buy a new mobile phone on the internet for £200, which came out of Toby’s bank account. a) Discuss Ken’s possible criminal liability for property offences arising out of his use of Toby’s bank card details on the internet.

  15. Lesson Objectives • I will be able to draw the relevant information from an exam question • I will be able to structure an answer correctly • I will be able to apply this to a given scenario
