APA KONVENSI CEDAW ITU? • Perjanjian Internasional paling komprehensif tentang HAM perempuan • Menetapkan kewajiban yang mengikat Negara Pihak secara hukumuntuk • Mengakhiridiskriminasi terhadap perempuan. • Menyatakan persamaan hak-hak sipil, politik, ekonomi, sosial dan budaya antara laki-laki dan perempuan. • Menetapkan bahwa diskriminasi terhadap perempuan harus dihapuskan melalui langkah-langkah hukum, kebijakan, program dan tindakan khusus sementara

  7. MENGAPA CEDAW PERLU ? Diskriminasi terhadap perempuan: • Terus berlanjut diseluruh dunia • Melanggar HAM • Asas-asas persamaan hak • Penghargaan terhadap martabat manusia • Kendala bagi partisipasi POLEKSOSBUD perempuan • Merintangi tumbuh kembang & kemakmuran masyarakat

  8. APA PRINSIP-PRINSIP CEDAW ? • Non-diskriminasi terhadap perempuan • Persamaan substantif melalui langkah-langkah • Korektif,Kompensasi dan • Tindakan khusus sementara • Kewajiban Negara (legislatif, eksekutif, yudikatif dan masyarakat)

  9. MENGAPA RI MERATIFIKASI CEDAW? • Ketentuan-ketentuan CEDAW pada dasarnya tidak bertentangan dengan Pancasila dan UUD 45 • Diskriminasi tidak sesuai dengan Pancasila dan UUD 45 • Semua warga negara sama kedudukan dalam hukum dan pemerintahan

  10. APA ARTI RATIFIKASI CEDAW ? Negara mengikatkan diri untuk : • Menghapus dan melarang diskriminasi terhadap perempuan secepatnya. • Memajukan, melindungi dan menegakkan HAM perempuan: • de jure dan de facto, • diranah publik dan privat • Memberdayakan perempuan agar dapat berpartisipasi penuh dan setara dengan laki-laki diranah privat maupun publik • Memberdayakan aparatur negara -legislatif, eksekutis dan yudikatif- maupun masyarakat serta menciptakan mekanisme nasional untuk menerapkan prinsip-prinsip CEDAW dan melaporkan kemajuan-kemajuan yang dicapai secara berkala kepada KOMITE CEDAW.

  11.  APA KOMITE CEDAW ITU ? • Badan Pengawas dan Pemantau Pelaksanaan Konvensi CEDAW oleh Negara-negara Pihak • Pengawasan dan Pemantauan dilakukan melalui dialog konstruktif dengan Pemerintah Negara-negara Pihak Konvensi berdasarkan laporan tertulis berkala dari Pemerintah  maupun laporan-laporan lainnya dari berbagai sumber. • Dorongan dan arahan CEDAW disampaikan antara lain melalui Rekomendasi Umum: sudah berjumlah 24, 3 diantaranya khusus bertalian dengan hak-hak ekonomi perempuan, yaitu nomor-nomor 13 (1989), 16 (1991) dan 17 (1991).
