Reminders - Fees • Fees (Env-A 700): (Regulation changed in 2004) • Emissions-based Fees: • 2004 fees were due in July 2005 • 2005 fees are due in April 2006 • All future emissions-based fees are due in April of the following year • Application Fees: (New Sources Only) • Temporary permit applications ($2000) • Air Toxics Review ($500 initial & $500 if a permit is required) • Modeling fees for initial permit applications: • $2500 for all devices subject to Env-A 607.01 • $1500 for sources only subject to Air Toxics Rule (Env-A 1400) • Major source fees • Testing and monitoring fees for temporary permits

Summary of 2006 Legislative Activities • SB 215 & HB 517 – Study committee & moratorium on the burning of construction/demolition derived materials: • Waiting for study report • HB1673 – Clean Power Act • HG and SO2 controls at Merrimack Station • HB 1146 /SB 314 - renewable portfolio standards

Regulatory Updates • Proposed Rule Changes include: • Draft Rule for BACT for the Combustion of Non-Exempt Fuels (Env-A 624) • Draft rule to JLCAR in May 2006 • New Source Review Reform • NH is proposing to maintain the existing NSR program with minor changes to include Plant-wide Applicability Limits • Emissions Guidelines for Other Solid Waste Incinerators (small MWCs) • NH is required to adopt rules and submit a State Plan to EPA for approval by December 2006

Regulatory Updates - Continued • Development of air regulations for landfills • Focus of the rules will be the capture and control of landfill gas • Goal is to have a rule drafted by December 2006 • Reviewing existing procedures regarding public notice of permit actions • In response to legislative concerns, ARD is considering revising the public notice procedures to include direct abutter notification and longer publication period
