Background • Orange County Ordinance #85-22 imposing the Six Cent Local Option Gas Tax (a six cent tax on every gallon of motor fuel sold in the County) was approved by the BCC on July 24, 1985 for 30 years. • The LOGT tax became effective September 1, 1985 and will be expiring on August 31, 2015. • LOGT is imposed in every county in the state.

  4. Background • As required by F.S. 336.025, an interlocal agreement between Orange County and its cities establishing the distribution of the revenue was approved by the BCC on April 8, 1997. • The interlocal agreement was effective October 1, 1997 and expires December 31, 2015.

Current Status • Pursuant to F.S. 336.025, LOGT revenue is shared by the County and its cities in accordance with the interlocal agreement. • The County’s share (about 64%) was $24.7M in FY 2013, averaging $24.4M over the past 10 years. • Revenue is used by Public Works for transportation expenditures, as defined by Florida Statutes.

Current Status • A new ordinance and interlocal agreement are required in order to reimpose the Six Cent LOGT for another 30 years. • Both the ordinance and interlocal agreement must be executed by the BCC before October 1, 2014 in order to continue the revenue stream without interruption. • On May 12, 2014, the City of Orlando approved the interlocal agreement.

  10. Board Action • At today’s public hearing, staff is requesting the following Board actions:

Board Action • Approval of an ordinance pertaining to taxation in Orange County, Florida; amending Article V of Chapter 25 of the Orange County Code to extend and reimpose the levy of the Six Cent Local Option Gas Tax and repealing Division 7 of Article II of Chapter 17 of the Orange County Code in its entirety.

  12. Board Action • Approval of the interlocal agreement with the City of Orlando for the distribution of Six Cent LOGT revenue.
