Paper 7.5.B – Report on Human ResourcesStaff Regulations Update Summary As advised at CRGA 48, SPC has been undertaking a review of the Staff Regulations and HR policies. • the need to strengthen organisational compliance; • ensure that an employment governance framework is up-to-date and responsive to evolving organisational and donor requirements; • enhance SPC’s organisational culture through improved HR processes and transparency. The project has so far undertaken: • Extensive staff consultations with the Staff Representative Committees and all employees; • Creating a dedicated intranet site to enable staff to view the proposed policy changes; • Training sessions for staff to seek clarity and provide direct feedback.

Paper 7.5.B – Report on Human ResourcesStaff Regulations Update Staff Regulations Working Group • CRGA 48 requested the formation of a Staff Regulations Working Group to consider any recommended changes to the SPC Staff Regulations and to undertake a final review before approval by CRGA. • The Working Group has provided valuable initial feedback on some proposed changes to the regulations. • Some key issues are still outstanding and these have attracted feedback in staff consultations. • The Secretariat considers that this may be of interest to the wider SPC membership and, before finalising these issues, would like to seek any further nominations for the Working Group to ensure broad input from members. • Implementation will be in 2019 with a finalised set of Staff Regulations and suite of HR policies, subject to review by the Staff Regulations Working Group and a request for CRGA’s approval out of session.

Paper 7.5.B – Report on human resourcesStaff Regulations Update Administrative Tribunal of the International Labour Organization (ILOAT) • An item considered by the Staff Regulations Working Group was the issue of SPC acceding to the jurisdiction of ILOAT. • The Secretariat proposed this option following recent cases in which France’s highest appeal court and local courts in New Caledonia asserted jurisdiction over SPC for certain staffing matters. • The Secretariat approached the ILO about the possibility of SPC acceding to its Administrative Tribunal’s jurisdiction. • The ILO provides the appeals body for 57 international organisations, including the World Health Organization, the Food and Agriculture Organization, UNESCO, the International Organization for Migration and the Green Climate Fund. • The Secretariat considers that having an impartial external body with significant relevant expertise as the appeals body for staff-related disputes would considerably strengthen SPC’s internal processes and its approach to staff relations.

Paper 7.5.B – Report on human resourcesStaff Regulations Update Administrative Tribunal of the International Labour Organization (ILOAT) • The ILO has carried out a preliminary assessment of SPC’s status and has advised that SPC can choose to become a member. • The costs of membership and hearings can be met from within existing resources. • While accession to ILOAT does not require an amendment to the SPC Staff Regulations, the Secretariat sought the views of the Working Group who endorsed the approach. • The Secretariat seeks CRGA’s approval to pursue accession to ILOAT as part of the review of the SPC Staff Regulations and HR policies. • The Secretariat also intends to consult staff on this mechanism and ensure appropriate policies and guidelines are put in place.

Paper 7.5.B – Report on human resourcesStaff Regulations Update CRGA is invited to: • note the progress of the review and update of SPC’s human resources policies; • note the progress of the SPC Staff Regulations Working Group; • nominate any additional members to participate in the SPC Staff Regulations Working Group to address key issues that are still outstanding; • direct the Secretariat to take appropriate steps to accede to the jurisdiction of the Administrative Tribunal of the International Labour Organization following appropriate staff consultation.
