  3. Amendment Process ( page 9) Essential Questions: • How does the Constitution protect our rights and freedoms? • Explain the 2 steps of the amendment process.

  4. Notes • Rights and freedoms: • Guarantees equality under the law with majority rule • Rights of the minority protected • Affirms (promises) individual worth and dignity of all people (= General Welfare) • Protects the freedoms of religion, speech, press, petition, assembly

  5. Sometimes the Constitution needs to be changed to protect these rights and freedoms • A change to the Constitution is an AMENDMENT.

  6. Amendment Process Every amendment starts with an IDEA (even you can propose an idea for an amendment!) • The idea then goes through a 2-step process to insure the amendment is constitutional and wanted by the people. • This is how DEMOCRACY works!

  7. Amendment Process: Step #1: Proposal- ask for a change Step #2: Ratification- Get the change approved 2/3 vote for action by Congress (or state convention) 3/4 of states ratify

  9. Article V of the Constitution outlines the amendment process • Since 1791 27 amendments have been added • The first 10 amendments were ratified immediately and called the “Bill of Rights”

  12. The 27 Amendments Amendment 1 • Guarantees 5 basic freedoms (religion, assembly, press, petition, speech) Amendment 2 • Right to keep and bear arms Amendment 3 • No quartering (housing) of soldiers in private homes

  13. Amendment 4 • No illegal searches or seizures Amendment 5 • Promises due process of the law • No double jeopardy • No self incrimination Amendment 6 • Right to a fair and speedy trial and a lawyer

  14. Amendment 7 • Right to a trial by jury in civil cases Amendment 8 • No cruel or excessive punishment or bail Amendment 9 - Citizens have rights even if they are not listed in the Constitution

  15. Amendment 10 • Powers not given to the federal govt are reserved for the states Amendment 11 • Rules for lawsuits against the states Amendment 12 -changes the process of the Electoral College in presidential elections

  16. Amendment 13 • Abolishes slavery Amendment 14 • defines who is a citizen • Promises equal protection under the law • Due process applies even at the state level of govt

  17. Amendment 15 • Voting right given to all male citizens Amendment 16 • Established income tax Amendment 17 • Direct election of senators by the people Amendment 18 - Established prohibition

  18. Amendment 19 • women’s suffrage (right to vote) Amendment 20 • Changes the presidential inauguration date to January Amendment 21 • Repeals the 18th amendment • Prohibition ends

  19. Amendment 22 • Presidential term limit set to two 4-year terms Amendment 23 -residents of Washington DC may vote in presidential elections Amendment 24 - End of the poll tax

  20. Amendment 25 • Established the presidential line of succession Amendment 26 • Lowers voting age from 21 to 18 Amendment 27 - Set limits on pay raises for members of Congress
