Judicial review e instituições políticas de controle constitucional: um estudo comparado entre Brasil e FrançaBolsista: Antonio Eduardo Reichmann Seixas - PIBIC/Fundação AraucáriaOrientador: Prof. Dr. Fabricio Ricardo de Limas Tomio O objetivo principal do trabalho é analisar comparativamente os sistemas de controle constitucional no Brasil e na França, através: da identificação do papel de tais institutos jurídicos nos respectivos ordenamentos; da análise da estrutura institucional dos países supracitados; da coleta de dados de processos no STF e no ConseilConstitutionnel. Análise de resultado das QPC (quéstion prioritaire de constitutionnalité) de 2010 a março de 2013 e das ADI (ação direta de incontitucionalidade) de 1988 até 2012: O método utilizado engloba: metodologia tradicional do direito comparado (micro-comparação específica); extensa pesquisa bibliográfica, tanto na literatura jurídica francesa quanto na brasileira; coleta de dados juntoàscortesconstitucionais e construção de base de dados sobre a frequência dos processos. Conclusões: númeroexcessivo de ADIs no Brasil, sobretudoaquelasaindaemandamento; rápidojulgamento das QPC naFrança; diferença e semelhança de percentuais; função “aperfeiçoadora” do direito comparado.
