DOCKtoberFest 2013October 25-27, Chicago, ILon Polk @Wells Streets PARTICIPATION EXHIBITOR: Subject to all terms set forth in this Agreement, Exhibitor is granted the right to sell and display artisan works, non-food and non-beverage products and marketing materials (with DFest Mgmt approval), but all promotional activity must be confined to exhibitor’s booth: NO signs, sales, models, or any product identification permitted outside the Exhibitor’s display area.ELIGIBILITY: Submission of a commercial space agreement and or payment for exhibitor space does not guarantee that exhibit space will be assigned. DFest reserves the right to determine the eligibility of any exhibitor for inclusion in the event, either before or after proper execution of this agreement. Applications for rental of vendor space shall be subject to the approval the Dfest Mgmt Committee and the DFest reserves the right to reject applications with or without cause if in the best interest of the festival SPACE ALLOCATION: The method of assigning spaces shall be established by the DFest Committee, and may be changed from time to time without notice to exhibitors in order to accommodate what the DFest perceives as the best interest of the event. EXHIBITING COMPANIES ARE NOT ALLOWED TO HAVE PETS WITHOUT DFEST PERMISSION IN WRITING. LIABILITY Neither the DOCKtoberFest, ChicagoWaterCraft LLC, River City Marina Condo Assn, the City of Chicago, Chicago Cultural Center, the State of Illinois, our representatives, agents, employees or any member or guests of the DOCKtoberFest and/or the facility on which the activities are presented, is responsible for any injury, loss, or damage from any cause whatsoever that may be suffered by an EXHIBITOR, their employees, agents, or property. The EXHIBITOR, upon execution of this agreement, expressly releases the foregoing named associations and businesses, parties, individuals, and employees for any and all claims for such loss, damage or injury. Any and all restrictions and/or levies imposed or enforced by the DOCKtoberFest, ChicagoWaterCraft LLC, River City Marina Condo Assn, the City of Chicago, Chicago Cultural Center, the State of Illinois must be observed by the EXHIBITOR, and/or the Venetian Boat Parade Festival nfp LLC assume no responsibility or liability whatsoever in matters related to any restrictions and/or levies imposed on any EXHIBITOR by the (event facility) DOCKtoberFest, ChicagoWaterCraft LLC, River City Marina Condo Assn, the City of Chicago, Chicago Cultural Center, the State of Illinois. No responsibility is assumed by the DOCKtoberFest, ChicagoWaterCraft LLC, River City Marina Condo Assn, the City of Chicago, Chicago Cultural Center, the State of Illinois, their agents or affiliates. For goods delivered to River City Marina, or for materials left on the premises after the event’s closing hours. EXHIBITORS who wish to insure their promotion and display materials, or components thereof, including products and merchandise, should do so at their own expense. Security guards will patrol the entire festival park and docks areas from (Oct 25, 2013) Friday at 5am through (Oct 27, 2013) Monday at 6am, but it is the responsibility of each EXHIBITOR to provide security for his/her own area. DOCKtoberFest, ChicagoWaterCraft LLC, River City Marina Condo Assn, the City of Chicago, Chicago Cultural Center, accepts no responsibility for lost or stolen goods. INSURANCE All EXHIBITORS must carry their own insurance and name the DOCKtoberFest, ChicagoWaterCraft LLC, River City Marina Condo Assn, the City of Chicago, Chicago Cultural Center, the State of Illinois as additionally insured on their policy for their space and MUST provide a copy of that insurance policy with aforementioned entities names noted on the document presented along with this EXHIBITOR’s application. It is the policy of DOCKtoberFest, ChicagoWaterCraft LLC, River City Marina Condo Assn, the City of Chicago, Chicago Cultural Center that EXHIBITORS must carry event insurance. If a EXHIBITOR doesn’t have insurance, they must contact DFest’s Insurer and get insurance naming the aforementioned entities as added insured on their booth insurance. BOOTH SIZE & CANOPYSee space directory!EXHIBITORS SPACE MUST HAVE A Secured CANOPY, with approval by our safety architect. If not, DFest Committee can rent EXHIBITORS a 10’x10’ or 10’ x 20’ canopy. See sizes and rates. WEAPONS No weapons of any kind are allowed on the premise of the DFest whatsoever.

    EVENT MERCHANDISEIt is hereby agreed and understood that an EXHIBITOR shall not have the right to use , sell, or giveaway products or marketing materials representing Dfest or RCM marks and logo or sell or giveaway any merchandise or product which would directly or indirectly compete with sponsor partnership contracts, or our association sales platforms without Dfest’s express written consent. It is agreed and understood that no acts or action shall be performed by an EXHIBITOR which would, in any way, connote an affiliation with Dfest without our express written consent. It is further agreed and understood that management of DFest shall determine any violation pursuant to the foregoing paragraph and take any action as necessary to eliminate infringement relative to the foregoing paragraph. Management of the DFest shall in its sole discretion determine if the EXHIBITOR is in breach of this agreement. EXHIBITOR will be expected to remove any and all conflict immediately or be subject to their immediate removal from DOCKtoberFest’s property and a fine not less than $5000 of more for trademark violation per occurrence as determined by State of Illinois legal system.GENERAL INFORMATIONThe DOCKtoberFest 2013 located north of River City Marina, on Polk St. @ Wells St. Chicago, IL. It is our understanding that our participation is subject to all conditions and regulations governing the event and its production. Cars may pull on east end of Polk Street to drop off or pull onto our River Walkup to 1pm with a 15 min grace period. Then only personal dollies and carts will be allowed on the interior of the fest. Friday MOVE-IN 8:00am – 2:00pm, Sunday MOVE-OUT: 8:15pm – 2:00am. NO CANCELLATIONS or REFUNDS (DEPOSITS are Not Refundable). NO SUBLETTING OF SPACE.   4. DOCKtoberFest 2013 Rules DOCKtoberFest, October 25-27, 2013…………….. Rules and Regulations All fees must be paid in full by October 4, 2013. ALL VENDORS “MUST CHECK IN” at the DFest Committee tent to confirm location UPON ARRIVAL. Vendors may set-up from 8am-2pm on Friday, October 25, 2013 and stay through 8:00pm on Sunday, October 27, 2013. It is the artisan’s or for-profit vendor’s responsibility to share with us what you intend to show and or sell prior to October 1, 2013. 4. Vendors may not have PA systems in their booth. 5. Vendors MAY NOT bring their own generator see Vendor forms. 6. Vendors MAY NOT bring outside food or drinks into the festival. 7. The Dfest Committee reserves the right to change, modify, move your tent, and reorganize all positions for the good of the festival. 8. Vendor’s total cooperation is expected and appreciated. 9. Check-in with the Art Fair Manager at the DFest Committee tent for your move-in and move-out assigned times. Same assignments will be posted on October 5, 2013. 10. This is a family event and all entries must be within the limits of good taste. 11. No alcoholic beverages may leave the event. 12. Each vendor /tent will receive 2 passes with the booth.
