  2. AUDIÊNCIA TRABALHISTA • Art. 813 da CLT – art. 817 da CLT • são públicas, salvo interesse público • Dias úteis (2ª a 6ª f.) • Das 08h às 18h • Máximo 5h, exceto matéria urgente (ex. pagamento salário – falência)

  3. AUDIÊNCIA TRABALHISTA • Princípio da concentração dos atos na audiência • É una (unidade) • É contínua (art. 849 da CLT), salvo força maior = acontecimento inevitável e imprevisível • Deverão estar presentes: Juiz do Trabalho, partes e datilógrafo

  4. AUDIÊNCIA TRABALHISTA • Reclamante ausente = arquivamento (art. 732 da CLT) - exceção: par. 2º do art. 833 da CLT • Reclamado ausente = pena de revelia e confissão quanto à matéria de fato - Súmulas 09, 122 e 377 do TST - confissão: ficta ou real • Obs.: Art. 322 do CPC – o revel apanhará o processo no estado em que se encontrar, intervindo em qualquer fase processual

AUDIÊNCIA TRABALHISTA • Reclamações plúrimas e ações de cumprimento – os empregados poderão se fazer representar pelo sindicato • Poder de polícia do Juiz: • manter a ordem e o decoro na audiência • Ordenar que se retire da sala qualquer pessoa que se portar inconveniente • Requisitar, quando necessário, a força policial (art. 816, CLT, c/c art. 445, CPC)
