On May 17, 2011, the Office of Juvenile Affairs’ Rates and Standards Committee voted unanimously to recommend an increase in the Level D rate from $72.62 per bed per day to $86.15 per bed per day. As required by statute, DCS was given notice of this rate proposal on May 18, 2011. On May 26, 2011, Department of Central Services, Col John S. Richard approved the rate proposal.

  3. Overview The Level D rate of $72.62 was established by DHS and adopted by OJA when the agency was established in 1995. The Board of Juvenile Affairs officially ratified the rate on May 8, 1997. The rate has not been modified since. The proposed increase represents a 19% increase.

  4. Legal Authority • 10A O.S. §2-7-305(B)(1) authorizes OJA to implement community-based residential care for juveniles, who are in the lawful custody of OJA and deemed by OJA to be in need of such services.

  5. Budget Impact • The budget impact is 13.53 per bed per day. For FY2012, since it is a leap year, the additional cost will be: $13.53 x 366 x 12 bed program. = 59,423.76. OJA has identified these funds from savings to be realized from the closing of the L.E. Rader Facility.

  6. Justification OJA currently has one 12 bed Level D program. The service provider has advised that the program is operating at a loss and they will not be able to continue providing services much longer.
