Packaging waste legislationEUDirective 94/62/EC Aims to harmonise national measures in order to prevent or reduce the impact of packaging and packaging waste on the environment and to ensure the functioning of the Internal Market. It contains provisions on the prevention of packaging waste, on the re-use of packaging, and on the recovery and recycling of packaging waste

National legislation - Act 11/1997, 24th april- (transposes Directive 94/62/EC) - Royal Decree 252/2006- (revises the Act 11/1997) - Regulation 782/98 of the Law 11/1997 OBJETIVE Prevent & reduce the impact of packaging and packaging waste on the environment and ensure their right management during all their life cycle. Establishes & Regulates the Collection Management Systems to fulfil the targets and objetives set in the Directive Law 10/1998, 21th april, of Waste OBJETIVE Transposes the principles of the EU Waste legislation Is a common law for all types of waste. It transfers competences & responsabilities of non hazardous waste, and urban waste mangement to Autonomous Communities

  9. Act 11/1997, 24th april WHO IS AFFECTED BY THIS LAW? Packaging producers and users of packaging (waste) are responsible for the correct management (and for its costs) of packaging generated/used. Persons or companies which are responsable for placing in the market the packaging products WHICH IS THE SCOPE OF THE LAW? Packaging includes products of any type used to contain, protect, handle, distribute and present goods, at any point in the manufacturing, distribution and consumption chain (Act 11/1997).

  10. Law 11/1997, 24th april HOW TO FULFIL THE LAW? Producers can fulfil their obligations Individually or through an IMS: A- INDIVIDUAL MANAGEMENT SYSTEM (DEPOSIT & RETURN SYSTEM) Each packaging producer enterprise creates its own packaging waste recycling system B- WASTE PACKAGING INTEGRATED COLLECTION MANAGEMENT SYSTEM The interested packaging producer enterprises can join this IMS, who is in charge of the desing and development of the waste packaging collection system and for the correct management of the packaging waste: The packaging waste management will end once the packaging waste has been recovery according the applicable operations provided for it in Annex II.B to Directive 75/442/EEC. Therefore, IMS are responsible for the fulfilment of the law obligations. If the packaging enterprises choose this system, they get free from their law obligations. Green point Membership symbol

Regional legislation Regional Act 10/2000, 12th december of waste of Valencia Region Establishes the legal regulation (requirements, targets and objetives, etc) for the production and the management of waste in the 3 provinces of our territory. Objective Prevention and reduction of the amount of waste generated and their dangerous and negative effects on the environment, by developing, planification, inspection & control instruments, to benefit self-sufficiency, security & efficiency of the waste management activities in the territory

The role of the administration • Local Administration • - Provides services of collection, transport, storage, recovery and elimination of urban waste. • - These services can be provided by municipal groupings, consortiums and other associations • - Those municipalities of more than 5.000 inhabitants will be provided with separate collection systems of urban waste. • - To join an packaging IMS they must sign an adhesion Protocol to the framework convention subscribed by IMS & Regional Administration Law 10/2000 on Waste in Valencia Region

The role of the administration • Autonomous Government • - Authorisation of management systems, both individual and collective- IMS. • - Co-ordination between IMS and local administration through framework convention • - To receive information from producers and IMS and exchange information with the central authority. • - Authorisation, monitoring, inspection. • - To provide recovery, recycling, waste management treatment plants. The role of the administration • Central Authority • - To keep the registry of industrial establishments, packaging section (Ministry of Industry, Commerce and Tourism) • - Exchange of information with the Autonomous Government, producers and IMS (Ministry of Environment) • - Establish databases on packaging and packaging waste to enable monitoring of the implementation of the objectives of the Directive (magnitude, characteristics and evolution of packaging and packaging waste flows, toxicity or danger of packaging materials) • - To supply information to the European Commission on quantities of packaging waste and meeting targets (Ministry of Environment) Law 11/97, April 24th Packaging & Packaging Waste

Waste management in Valencia Community • The Integrated Waste Plan (IWP) is the main instrument for managing and co-ordinating all the tasks relating to waste in the Valencian Region, & to reach the targets established by the Law 10/2000 of waste. • The IWP divides the Valencian Region into 18 zones, to achieve a better operativity in waste management. • The IWP can be enforced directly or through the Zonal Plans and management projects for urban waste.

Waste management in Valencia Community • The Zonal Plans are made by the Environmental Regional Authority. • They establish the quantity of different centres for managing the urban waste in each Zone (landfills, treatment plants, etc.) to be self-sufficient. • The management body of each Zone Plan, a Consortium, is constituted of representatives of the Autonomous Government, the Provincial Government and the local authorities. • To be constituted, at least, 51% of the population must be represented.

Waste management in Valencia Community • The management plans serve to develop the Zonal Plan, concerning those wastes within the public service • They can come from private or public initiative • The relevant authority chooses the best management plan • The selected agent will enter into a contract with the consortium.

Packaging waste management plants of Valencia Community At the moment there are 4 IMS for packaging waste authorised by the Environmental Regional Ministry in our region, 2 of which deal with the collection of household packaging waste, ECOEMBES & ECOVIDRIO 4 Household Packaging waste treatment plants: Alzira, Picasent, Castellon, Benidorm & Villena (only packaging transfer plant)

Producers can fulfil their obligations individually… INDIVIDUAL MANAGEMENT SYSTEM ... or through one of the INTEGRATED MANAGEMENT SYSTEMS A system for collection, transport and treatment, by which the producers fulfil their obligations regarding the management of the packaging waste they have placed on the market. This system is financed by the producers in agreement with others economic operators/parties involved. The IMS are non-profit making They must submit an Annual report to the authority, certified by external auditor The financing is guaranteed by the producers

INTEGRATED MANAGEMENT SYSTEMS - Each IMS must be authorised in the autonomous community where they want to operate. - The IMS for packaging waste have to deal with the local authorities through a framework convention. The Co-ordination between them will be supervised by the Environmental Regional Ministry. - Actually there are 4 IMS for packaging waste in our region. - 2 specific for household packaging waste: ECOEMBES & ECOVIDRIO they have their head offices in Madrid & currently they operate in 17th autonomous communities of Spain. - According to our regional law, the Regional government must provide the necessary waste treatment infrastructures for the right management of waste in our region, including the creation of the packaging treatment plants.

Obligations associated to IMS • Sing an adhesion contract with the IMS • ECOEMBES:paper/cardboard, plastics, briks, steel, aluminium, wood, ceramics & others packages. • ECOVIDRIO:glass (private agreement between parties) • SIGRE:pharmaceutical packaging waste • SIGFITO: fitosanitary packaging waste • Payment of the fee established for each package place in the market. • Rate for the use of green point • Art. 10 de la Ley 11/1997 • Identification of the packaging products with the green point symbol(only for household IMS) Art. 7.2 del RD 782/1998 • They must submit a Packaging Declaration Annual report to the IMS

MANAGEMENT TREATMENT PLANTS - The managers in charge of the waste packaging treatment plants, must adapt them to the technical requirements and conditions established in the related legislation. - A co-ordination between the different IMS, the managers of the treatment plants & the local authorities, by the Regional Government is needed, in order to have a satisfactory economic compensation between them, as a result of their respective tasks and for the correct management and treatment of the packaging waste. - After the packaging waste is treated in the packaging treatment plants, the recovered materials are temporary storage & classified into different types. Finally sent to the corresponding recovery plants for their right and final treatment.

  40. CITIZEN AWARENESS The success of separate waste collection requires above all a general public commitment. The regional environmental ministry in collaboration with the IMS, promote regional & local communication campaigns and educational activities. Publicity campaigns, conferences, school seminars and university courses are some of the tools used to widen public awareness on the issues related to waste recycling and recovery.

  41. CHALLENGES TO BE ACHIEVED To fully achieve the targets set by the European and Spanish legislations a number of focus areas must be achieved. IMPROVEMENT IN COLLECTION QUALITY The quality of collected material is fundamental, both for collection costs and for recycling . DEVELOPING COLLABORATION WITH LOCAL AUTHORITIES AND WASTE MANAGEMENT COMPANIES Building a shared path towards optimized waste management and spreading best practices in waste collection management. PROMOTION OF THE RECYCLING MARKET Promote between the consumers to pay particular attention to the market of recycled materials and to the products from recycling, and support programs for a deeper knowledge of recycled products among citizens and municipalities.
