  1. SLR, PTD and SAR Division I Advanced Track Academic and Membership Affairs

  2. Multiple Waivers Best Practices • Communicate with NCAA academic and membership affairs (AMA) staff members regarding submission of multiple waivers. • Use instructions for multiple waiver filings on AMA Online.

  3. NCAA Division I Legislative Council Subcommittee for Legislative Relief (SLR) Waiver • What NCAA bylaws are involved in this waiver request? • Bylaw 14.5.5.1 – General transfer rule. • Bylaw 14.5.5.2 – Unfulfilled academic year in residence due to not meeting 2-4 transfer requirements. • Bylaw 14.5.5.4 - Eligibility for institutional athletically related financial aid.

  4. SLR Waiver – Staff Analysis • When did Big Time University begin recruiting Joe? • September 2009. • How many hours did Joe attempt and earn at the two-year institution? • Joe attempted and earned 60 credits. • Why did only 45 of the 60 transfer to Big Time University? • Joe earned 12 hours of “D” credit that were not transferable to Big Time University; it only accepts courses in which a student-athlete (SA) earned a grade of “C” or better. • 3 hours were elective courses that were not transferable. • Unfulfilled academic year in residence due to 2-4 transfer requirements:

  5. SLR Waiver – Staff Analysis (continued) • Any mitigation to explain Joe’s academic record at the two-year institution? • No. • What did Big Time University inform Joe during the recruiting process? • Informed Joe that he only needed to get associate degree. • When did Big Time University conduct Joe’s transfer certification? • During official visit in September 2009; did not get final transcript until December 2010.

  6. SLR Waiver – Staff Analysis (continued) General transfer rule due to financial hardship: • What is cost of attendance (COA) and financial aid packages at both institutions? • Big Time University’s COA is $25,000. Joe received a $20,000 athletics scholarship. • State University’s COA is $20,000 and State would like to provide Joe with athletics aid. • Did Joe try to secure additional financial aid at Big Time University? Why or why not? • Yes, Joe did not qualify for additional scholarship but did qualify for $10,000 in outside loans.

  7. SLR Waiver – Staff Analysis (continued) • What was Joe’s family contribution at both institutions? • Parents provided Joe with $5,000 at Big Time University but will be unable to provide Joe any additional money at State University. • Does Big Time University support waiver request and acknowledge its errors? • Yes.

  8. SLR Waiver Guidelines Assertions of misinformation: • SA relied in good faith on academic misinformation; • When misinformation provided by previous four-year institution led to SA being ineligible; • Applicant institution can document that SA would have been eligible had he/she attended applicant institution directly; and • Possible 10-day case depending on documentation.

  9. SLR Waiver Guidelines (continued) Assertions of financial hardship: • Financial hardship is a result of a specific incident and has a direct link to warrant relief from the legislation (i.e., chronology). • COA at previous institution and applicant institution and what actions SA took to remain at previous institution.

  10. SLR Waiver Guidelines (continued) Assertions of financial hardship: • Total financial situation at previous institution vs. applicant institution, including contributions from parents. • SA’s anticipated graduation date and academic status at time of departure from previous institution.

  11. SLR Waiver Decision STAFF APPROVED : • 1999 Guidelines for Misinformation. • Error when conducting Joe’s transfer eligibility. • 1999 Guidelines for Assertions of Financial Hardship. • Chronology and documented cost savings. • Joe satisfied all other 2-4 transfer requirements. • Previous institution supports waiver.

  12. Progress-Toward-Degree (PTD) Waiver

  13. PTD Waiver (continued) • Fall 2011 • GEO 231: 3 credits • GEO 425: 3 credits • ENG 230: 3 credits • Elective: 2 credits • Elective: 2 credits 13 • Fall 2012 • HST 334: 3 credits • HST 400: 3 credits • ANT 450: 3 credits • Elective: 3 credits 12 Academic Recovery Plan (120-credit program; completed 68) • Spring 2012 • SCO 331: 3 credits • ANT 401: 3 credits • HUM 430: 3 credits • GEO 320: 3 credits • GEO 300: 3 credits • 15 • Spring 2013 • SCO 431: 3 credits • ANT 430: 3 credits • GEO 320: 3 credits • Elective: 3 credits • 12

  14. PTD Waiver (continued) • What is Joe’s progress-toward-degree deficiency? • What other questions should the staff ask State University about Joe? • What documentation is required to review this case?

  15. PTD Waiver (continued) • What are Joe’s progress-toward-degree deficiencies? • Does not meet percentage of degree (60%) [Bylaw 14.4.3.2]. • What other questions should the staff ask State University about Joe? • Is there documentation of the financial hardship incident? • Could Joe have attended summer school? • Why were some courses not degree-applicable (grades, not transferable)? • What has changed for Joe?

  16. PTD Waiver (continued) • What documentation is needed to review this case? • Standard documentation (completed online application, official transcripts, etc.). • Evaluation of transfer credit. • Documentation of the incident that caused the financial hardship. • Documentation of Joe’s summer activities (employment records).

  17. PTD Waiver – Staff Analysis • How close is Joe to meeting the requirements? • 4 credits short of meeting the 60% requirement (needs 72, has 68). • Overall academic record?

  18. PTD Waiver – Staff Analysis (continued) • What is the likelihood that Joe will graduate within5 years of initial enrollment? • Quality-point analysis: 68 credits x 2.5 = 170; 12 credits x 2.8 = 33.6 • Overall, greater than 50% chance of graduation; 33-50% chance at State University. • Academic recovery plan – is it reasonable? • Will Joe meet future benchmarks (80%)?

  19. PTD Waiver – Staff Analysis (continued) • Does the mitigation support the deficiency? • Does the documentation support the mitigation? • Have verification of father losing job (letter of termination, unemployment documentation). • Have verification that Joe has been working all summer (statement from employer, pay stubs, etc.). • What has changed for Joe? • Does father have job? • Is Joe on athletics aid? • Has Joe discussed other options for financing education?

  20. PTD Waiver – Decision • Approve. • Rationale. • Personal hardship. But for the family’s financial issues, it seems reasonable to believe Joe would have attempted and passed at least 4 credits during summer school in order to meet the requirement.

  21. Student-Athlete Reinstatement (SAR) Issues • Was Joe eligible at Big Time University for: • Practice? • Competition? • Athletics aid? • Travel? • Is Joe now eligible to compete at State University given violation at Big Time University?

  22. Bylaw Citations • Bylaw 14.4.3.2 (Fulfillment of Percentage of Degree Requirements). • Bylaw 14.5.4.2 (Two-Year College Transfers – Not a Qualifier). • Bylaw 15.01.5 (Eligibility of Student-Athletes for Institutional Financial Aid). • Bylaw 16.8.1.2 (Competition While Representing Institution).

  23. SAR Questions and Documentation Needed • Practice and Competition. • How many practices did Joe participate? • 44 practices. • What was the specific date Joe learned he was not meeting 2-4 transfer requirements? • December 29, 2010.

  24. SAR Questions and Documentation Needed • Financial Aid. • What was the amount of impermissible athletics aid received? • Fall 2010 - $10,000. • Documentation from Big Time University substantiating amount of athletics aid Joe received.

  25. SAR Questions and Documentation Needed • Could Joe have been eligible under another degree program? • No. • Could Joe have rectified his deficiency prior to enrollment at Big Time? • Possibly, but note academic performance during 2009-10. • Statements from Joe, individuals responsible for misadvising him and miscertifying him.

  26. Violation Summary • 15 contests. • 44 practices. • $10,000 impermissible aid. • Travel while ineligible. What would help SAR staff with decision?

  27. Guideline Summary • Practice and Competition (Bylaw 14.5.4.2). • 1 for 1 withholding. • Athletics Aid (Bylaw 15.01.5). • Repayment to charity or institution.

  28. Staff Considerations • Are there any mitigating factors from guidelines? • Does case precedent offer guidance?

  29. Mitigation • Misadvisement by Big Time University. • Reliance by SA. • Joe could have been immediately eligible at State University. • 3 credits short.

  30. Decision • Withhold 4 contests (1 for 4). • Fulfill during 2011-12. • Withhold 11 practices (1 for 4). • Staggering opportunity. • Repayment of financial aid. • ($10,000).

  31. Take-Aways • Communicate with the AMA staff. • Exhaust the interpretive process. • Clarify what you need and request relief. • Collect all information and submit through AMA Online. • Substantiate mitigation with documentation. • Work with previous institution when appropriate. • Use guidelines and case precedent when appropriate. • Propose recommended outcomes with rationale. • Timing of submission.
