Authority • Florida Constitution, Article VIII, Section 1(g): “Counties operating under county charters shall have all powers of local self-government not inconsistent with general law, or with special law approved by vote of the electors. The governing body of a county operating under a charter may enact county ordinances not inconsistent with general law. The charter shall provide which shall prevail in the event of conflict between county and municipal ordinances.”

Authority (Cont.) • Orange County Code, Chapter 30, Article III, Section 30-76: “The county hereby determines that the provisions of this article are declared to be necessary for the promotion, protection and improvement of the public health, safety, comfort, good order, economy, appearance, convenience, prosperity, morals and the general welfare of the citizens and residents of the county, and it is in the best interest of the citizens and residents of the county to require the harmonious, orderly and progressive development and use of land within the unincorporated areas of the county. In furtherance of these purposes this article authorizes and provides for the proper development and use of land in the unincorporated areas in the county and authorizes the board of county commissioners to establish rules and regulations that are reasonable and necessary to carry out the purposes of this article. The board of county commissioners is authorized and empowered to amend or revise and enforce such rules and regulations.”

Areas of Enforcement • Construction • Residential Development (County maintained) • Inspectors • Certificate of Completion (COC) • Acceptance for maintenance by Roads and Drainage (1 yr after COC) • Commercial/Industrial Development • Inspectors • Certificate of Completion (COC) • No further involvement from Public Works • Gated Communities (Privately maintained) • Inspectors • Certificate of Completion (COC) • Year End Final Inspection • No further involvement from Public Works

Application Process • Planned Development (PD) , Preliminary Subdivision Plan (PSP) and Development Plans (DP) - Development Review Committee (DRC) • Application and plans reviewed by Public Works (PW), Fire Rescue, Utilities, Planning, Zoning, and EPD • 20+/- days review • Subdivision Plans • Application and construction plans reviewed by PW, Fire Rescue, Utilities, Planning, Zoning, and EPD • 30 day review • Commercial/Industrial Plans • Application and construction plans submitted to Building Safety Division and distributed for review to all reviewing Departments/Divisions • 21 day review - initial plans submittal / 14 day review - revised plans submittal

Application Process (Cont.) • Engineering “E” Projects (work within Right-of-Way) • Application and construction plans reviewed by Public Works • 30 day review • Excavation/Fill/Mass Grading Plans • Application and construction plans reviewed by PW, EPD and Zoning • 30 day review • Lot Grading Plans • Application and construction plans reviewed by PW and EPD • 14 day review • Master Drainage Plans • Application, construction plans and calculations reviewed by PW • 30-45 day review
