  1. Southeast Louisiana Flood Protection Authority – West West Jefferson Levee District Algiers Levee District West Bank and Vicinity Hurricane Protection Project

  2. PROPOSED LEGISLATION • The U. S. Army Corps of Engineers has proposed and is now implementing the installation of navigable floodgates as features within both the Lake Pontchartrain and Vicinity and the West Bank and Vicinity Hurricane Protection Projects. • The LPV Inner Harbor Navigation Canal (IHNC) and the WBV GIWW West Closure Projects are to be constructed in response to the Corps congressionally mandated orders to provide a 100 year level of flood protection for the New Orleans area of southeast Louisiana.

PROPOSED LEGISLATION • The implementation of any project that uses a navigable sector gate will create an obstruction to the Gulf Intracoastal Water Way (GIWW) a Federal navigable waterway of the United States. • Because of its commercial marine traffic the United States Coast Guard and the U. S. Army Corps of Engineers bear the responsibility for management and enforcement of the use of the water way as a normal government function.

  4. PROPOSED LEGISLATION • Because of their location, in the middle of a very busy Federal water way, both navigable floodgates will require a full time staff to operate and maintain the facilities and to provide a constant vigil against damage from marine interests that will pass through them on a daily basis. • The operation and maintenance cost of both navigable floodgates will be very expensive and beyond the funding capacity of either flood protection Authority.

PROPOSED LEGISLATION • The Southeast Louisiana Flood Protection Authority – West and the Southeast Louisiana Flood Protection Authority – East are requesting the Coastal Protection and Restoration Authority to lead the effort of requesting the Congress to adopt legislation to direct the U. S. Army Corps of Engineers to bear the cost and responsibility for the operation and maintenance of all navigable flood gates and appurtenant structures constructed for the purpose of flood control that are located within a Federal navigable water way
