  1. Disability, Public/Private Health Service

Has the<Disabled Discrimination Act> achieve its goal? 許傑B9802095 醫學二B
  2. What is “disabled”…? Nick Vujicic
  3. Disabled Definition: By medical point: a physical or mental impairment that has a substantial and long-term adverse effect on his/her ability to carry out normal day-to-day activities. By social point: It is the traditional concept which causes the individuals to be “disabled” in the environment. Ex: No ramps in buildings.
  4. Outline Introduction: Definition of “disabled” My question…How to improve the disabled's life quality? Body: By individual Cultivate hobbies Sports Drawings Join clubs Counseling By social law The law in foreign countries (UK) The law in Taiwan Welfare foundations Conclusion: Sports: We can held all sorts of contests or tournaments Law: The law hasn’t achieve its goal but is on its way.
  5. If you are disabled… How will you improve thelife quality of the disabled?
  6. If you are disabled… Disabled’s Welfare Disability Law UK:DDA Taiwan:Physically and Mentally Disabled Citizens Protection Act Disability Foundation Liu educational consulting(財團法人劉氏社會福利事業基金會) Republic of China Association For Mentally Handicapped Person(中華民國啟智協會) The League of Welfare Organization for Disabled R.O.C.(中華民國殘障聯盟)
  7. Disability Discrimination Act It was legislated to make ”discriminating against disabled persons in connection with employment, (…)” to be unlawful. Service providers have had to make 'reasonable adjustments' for disabled people, such as providing extra help or making changes to the way they provide their services. Consolidated into the Equality Act (2010). PASSIVE ->ACTIVE
  8. What turns out… less favorable treatment for a reason related to a disabled person's disability failure to make a "reasonable adjustment"
  9. The problem… For adjustment: The Disability Rights Commission's Codes of Practice: whether the proposed adjustment would meet the needs of the disabled person whether the adjustment is affordable whether the adjustment would have a serious effect on other people The Act therefore permits employers and service providers to justify less favorable treatment in some circumstances.
  10. The problem…(continued) Exemption of small firms(15 employees under) ‘reasonable adjustment’ clause that enables employers to justify some non-adherence monitoring of compliance by employers Narrow definition of disability Puts burden of proof upon the disabled Prove they are disabled under the terms of act Discriminated against on this basis
  11. Data analysis
  12. Discussion Probably DDA needs a longer time to make a detectable effect. There are other factors which effect employ rates, such as recession. There are no other information about the experience of DDA, so it is hard to any definite conclusions.
  13. Conclusion The employment gap isn’t closed after the onset of DDA. On contrary, it increased. DDA is a disguised form of suppressing the disabled. The disadvantages of DDA shouldn’t be neglected, and addition to the act is needed.
  14. Thanks for your attention
