  5. 2012–13 Applications Applications for 2012–13 Limited English Proficient (LEP) and Immigrant Education Student Subgrant Programs have been submitted by local educational agencies (LEAs). Any LEAs who missed the application deadline will have to wait until 2013-14 to determine their eligibility and apply. 5

  6. 2012–13 Private School Participation Private school requests to participate (Immigrant) and private school reports via the Con App (LEP) have been completed. A memorandum of understanding should be completed by October 31, 2012, for any participating private schools. 6

  7. 2012-13 Awards The 2011–12 Title III estimated per pupil amounts are: LEP: $104.05 Immigrant: $100.00 7

  8. 2012–13 Awards Title III sub-grantees no longer receive an award letter from the Language Policy and Leadership Office (LPLO). Funding information is available on the Title III Immigrant and LEP Entitlement Listing page at: http://www.cde.ca.gov/sp/el/t3/tiiiapportnotify11.asp. 8

  9. End of Year Expenditure Reports End of Year (EOY) expenditure reports for Direct Funded and Consortia LEAs are projected to be available via CARS online October 2012. Consortia leads will only report for the year(s) they were the lead. The LPLO will not be sending the notification-LEAs will receive notice via CARS. 9

  10. End of Year Expenditure Reports LEAs must report all obligations on the EOY expenditure report. According to the California State Accounting Manual, “Legal obligations are commitments made by an LEA to purchase goods or services immediately or in a future period.” To determine whether a financial commitment should be reported as an obligation, please refer to Title 34, Part 76, Section 707 from the Code of Federal Regulations (CFR): Retrieve by CFR citation Web page at http://www.gpoaccess.gov/cfr/retrieve.html. 10

  11. End of Year Expenditure Reports All obligations must be liquidated no later than 90 days after the funding period ends. FY 2010–11 subgrant obligations need to be liquidated by December 30, 2012. 11

Title III Accountability Title III under the federal Elementary and Secondary Education Act (ESEA) provides supplemental funding to LEAs and consortia Funds are to be used to implement programs designed to help English learners (ELs) attain English proficiency and meet the state’s academic and content standards

Title III Accountability • Is a series of annual academic performance goals established for each LEA or consortia of LEAs to hold them accountable for progress and performance of ELs • LEAs are determined to have met their accountability goals if they meet or exceed each year’s accountability targets and criteria

Title III Accountability Title III, Part A, Subpart A, Sections 3121 and 3122, of the ESEA requires that each state: • Establish English language proficiency standards • Conduct an annual assessment of English language proficiency • Define two Annual Measurable Achievement Objectives (AMAOs) for increasing the percentage of EL students’ developing and attaining English proficiency • Include a third AMAO relating to meeting the Adequate Yearly Progress (AYP) for the EL subgroup at the LEA or consortium level • Hold LEAs and consortia accountable for meeting the three AMAOs (ESEA Section 3122)

California’s Definition of Annual Measurable Achievement Objectives • An Annual Measurable Achievement Objective (AMAO) is a performance objective, or target, that Title III subgrantees must meet each year for their EL populations • All LEAs and consortia receiving a Title III-LEP grant are required to annually meet the two English language proficiency AMAOs • All LEAs must also meet a third academic achievement AMAO based on AYP information

Consequences of Not Meeting Annual Measurable Achievement Objectives If a Title III or consortia does not meet any one or more of the three AMAOs in any year, it must: • Inform the parents of all ELs in the LEA or the consortia as a whole, that the AMAOs have not been met • This notification should be provided within 30 days of the public release of the Title III Accountability Report

  26. Development of a Title III Year 2 Improvement Plan Pursuant to requirements of ESEA, Section 3122(b)(2): • LEAs and consortia that fail to meet one or more AMAOs for two consecutive years (FY 2010–11, and FY 2011–12) must also develop an improvement plan that will ensure all AMAOs are met

Development of a Title III Year 2 Improvement Plan • The improvement plan shall specifically address the factors that prevented the LEA or consortium from achieving the AMAO targets • This requirement can be addressed via the Title III Year 2 Improvement Plan (IP) on the California Accountability and Improvement System (CAIS) • More information on the IP is available at the CDE Accountability Requirements Web page at http://www.cde.ca.gov/sp/el/t3/t3amaotargets12asp.

  28. Projection of Year 2 LEAs in Improvement Status • Based on 2010-11 data, up to 96 LEAs will be identified as not having met one or more AMAOs for two consecutive years • A more accurate number will be available upon release of the 2011-12 Accountability Reports

Consequences of Not Meeting AMAOs for 4 Years Pursuant to requirements of the ESEA, Section 3122 (b)(4), and approved by the State Board of Education: • LEAs and Consortia failing to meet one or more AMAOs for four consecutive years (2008–09, 2009–10, 2010–11, and 2011-12) are also required to modify their curriculum, program, and method of instruction

  30. Development of a Title III Year 4 Improvement Plan • This requirement can be addressed via the Title III Year 4 IP on CAIS • More information on the improvement plan is available in the CDE Accountability Requirements Web page at http://www.cde.ca.gov/sp/el/t3/t3amaotargets.asp.

  31. Projection of Year 4 LEAs in Improvement Status • Based on 2010-11 data, up to 66 LEAs will be identified as not having met one or more AMAOs for four consecutive years • A more accurate number will be available upon release of the 2011-12 Accountability Reports

  32. Notice of Improvement Status LEAs and consortia that are identified as not meeting AMAOs for two or four consecutive years will be notified by the CDE of further action that needs to be taken

Technical Assistance for Year 2 and 4County Office of Education Leads • The CDE and the County Office of Education (COE) Leads, in partnership with the CACC at WestEd provide technical assistance to LEAs to support the development, implementation and monitoring of the Year 2 and Year 4 Plans • In fiscal year 2012–13 the CDE will disburse $2 million in Title III local assistance funds to eleven County Offices of Education
