  1. No Increase in Pollution Load Certificate. What is it ? and Why do you Need One? In a recent Government Order issued by the Ministry of Environment, Forest, and Climate Change (MoEF&CC) on March 2, 2022, industries listed under sectors 2, 3, 4, and 5 (such as Coal washeries, Mineral Beneficiation, Metallurgical Industries, Cement plants, Distilleries, Sugar plants, etc., as per the Schedule of the EIA Notification, 2006) now have the opportunity to increase their production capacity by up

  2. to 50% without going through the entire Environmental Impact Assessment (EIA) process again. It is important to note that this provision applies only to projects or activities that were previously granted Environmental Clearance (EC) under the EIA-1994/2006. Under the No Increase in Pollution Load (NIPL) provision, there are specific conditions that need to be met in order to apply for expansion: 1. The pollution load must not be increased. 2. No new equipment or machinery should be added compared to the EC granted. 3. Installation and implementation of an Online Continuous Monitoring System (OCMS) with at least 95% uptime is mandatory. This system should be connected to the servers of the Central Pollution Control Board and State Pollution Control Board to report the quantity and quality of emissions and discharges. Expansion can be achieved with or without changes in the following aspects:

(i) Raw material mix, (ii) Product mix, (iii) Quantities within products, (iv) Number of products, including new products falling in the same category, (v) Configuration of the plant or process, or operations in the existing area or in areas contiguous to the existing area. The benefits of this provision include avoiding the need to go through the entire EC process again for expansions within the specified sectors and up to 50% of the existing capacity as per the EC. The allowed percentage may vary depending on the project. To apply under the NIPL provision, you can register through PARIVESH, an online portal. If you are already a registered user, log in using your username and password. If you are not registered, you can select the project proponent/user agency and complete the registration process.

  4. Fill in the required details and upload the necessary documents. Once your user login is complete, select “Intimation Concerning NIPL” and provide appropriate responses to the questions posed.
