State Authorization, Chapter 34, § 600.9(c) “If an institution is offering postsecondary education through distance or correspondence education to students in a State in which it is not physically located or in which it is otherwise subject to State jurisdiction as determined by the State, the institution must meet any State requirements for it to be legally offering distance or correspondence education in that State. An institution must be able to document to the Secretary the State’s approval upon request.”

  11. Other Considerations • Some state agencies are open to helping students finish their program through teach-outs. • MA • DE • AL • De minimus standards. • Agencies may be open and willing to work with you, be informed, friendly, and ask. Build relationships.

  12. Surveys • UPCEA / WCET Survey – What are institutions doing? • Results available in the next few weeks. • SHEEO Survey – What are state regulations? • Sent out to all state agencies two weeks ago, results will be available in early fall.

Complaint Processes • Chances are that you are not in compliance! • Inform students complaint processes • Accreditation & state regulator complaint processes for each state. • Current and prospective students. • Not just distance education. • July 1, 2011 deadline. • NCHEMS has a model, but per DOE, you need to provide your own list to students. • http://www.sheeo.org/stateauth/Links to Complaint Process.pdf
