Rights, obligations and responsibilities of a coastal State Refers to para 48 of III Code: • Radiocommunication services • Meteorological services and warnings • Search and rescue services • Hydrographic services • Ships' routeing • Ship reporting systems • Vessel traffic services • Aids to Navigation

Obligations Obligations - refer to Annex 3 to the Non-exhaustive list of obligations under instruments relevant to the III Code SOLAS chapter V: • Search and rescue services (SAR Convention) • Vessel traffic services – resolution A.857(20), Guidelines for Vessel Traffic Services covering • Annex 1 – Guidelines and criteria for VTS • Annex 2 – Guidelines on Recruitment, Qualifications and Training for VTS Operator

Obligations • Maritime pollution incidents • Oil pollution response unit • SOLAS VII – reporting of incidents involving dangerous goods (reporting guidelines – A.851(20)) • MARPOL Annex I/4.3 and II/3.1.3 – exceptions for combating pollution incidents • MARPOL Annex II/13.2.3 – control of discharge of residues of NLS – agreement and communication to IMO • Casualty investigation

  10. Enforcement • Refers to paragraphs 49 and 50 of the III Code • Control and monitoring programme in place for: • Trend analysis • Timely response to pollution incidents • Cooperation with Flag State and/or Port State in investigations of maritime casualties

  11. Coastal State activities - Evaluation and review Refers to paragraph 51 of the III Code • Member State to have a mechanism in place for periodic evaluation of the performance in fulfilling its coastal State obligations • This mechanism is to confirm whether measures taken in exercising the Member State's rights and meeting its obligations under mandatory IMO instruments are: • effective • lessons learnt for continuous improvement
