Strategic Directives Strategic Directives • SD-8.6: “Seek additional legislative authority by September 2008 for more effective enforcement by LEAs and the CIWMB, including… addressing illegal disposal” • SD-8.9: “Evaluate by January 2008 potential statutory and funding options to enhance local and regional capabilities to prevent and redress illegal dumping”

Key Activities • Team Illegal Dumping – July, 2007 - Cleanup, Closure & Financial Assurance Div. - Tire Facilities Operations and Evaluation Br. - Cleanup Branch - Compliance Evaluation and Enforcement Div. - Permitting and LEA Support Division - Local Assistance & Market Dev. Division - Statewide Technical & Analytical Resources Div. - Grants and Loans Branch - Office of Public Affairs - Legislative Office

Key Activities • Team Illegal Dumping (TID) • Analyzed IDETF Recommendations • Review of Loans and Grants – simplification • Waste Tires – More Amnesty Days, LEA Cleanup Grants expanded • White Goods – Extended Producer Responsibility (EPR) – potential inclusion • Support development of Best Management Practices (BMP)-enhanced web site • Support development of Outreach & Public Awareness components

Best Management Practices - Enforcement • Committee – Cities of Los Angeles & Fresno, County of Imperial • Utilize existing policies and procedures as basis • Web based- Prevention, Enforcement, Abatement • Emphasize interactive availability for local agencies • Legal Office Intern reviewed existing county codes • Address IDETF Recommendation 3,9,13,17-19,21 • Completion scheduled for Spring 2008

Outreach and Public Awareness • Committee being established – Practicing staff from City of Oakland, Solano and Kern Counties, Sustainability Program and Public Information Office • Identify components for inclusion in contract allocation proposal • Audiences- general public, practitioners, dumpers • Addresses IDETF Recommendation 8,9,15,24 • Six week completion schedule

New River Pilot Project • Board/Imperial County/CHP aerial survey of New River identified 47 illegal dump sites • All sites have been characterized and 37 of the properties are privately owned • All property owners have been sent Notices to Abate by Imperial County staff • Potential master agreement for cleanup under Farm and Ranch Grant program • Emerging policy issue on waiver of cost recovery on private property

  8. Areas Which May Require Additional Statutory Authority 1. Identify CIWMB as lead state agency 2. Grants for funding and development of local programs 3. Allow illegal dumping in Local Enforcement Agency Enforcement Program Plan 4. Local permit program for refuse hauler service providers 5. Define evidence of ownership – illegal dumping 6. Tire dealers to retain waste tires being replaced by vehicle owners
