  12. Highlights of SHRM HR Week • Tenth Circuit decides that employers are not required to provide more than six months of leave as a reasonable accommodation under the ADA. According to the court, employees who cannot work for six months are not “qualified” to perform the essential functions of their positions. • Upcoming SHRM Member Webcasts: • “Datafication of HR” (i.e., learning how to use analytics to plan strategically): July 29, 2:00 p.m. ET SHRM’s HR Week emails are available to all members of SHRM National. Please see any member of the Michiana SHRM board for more information about becoming a SHRM National member.

Legal Update • Supreme Court invalidates recess appointments to NLRB because they were not made during a “recess.” • Affects cases decided between 1/4/2012 (when the appointments were made) and 8/12/2013 (when the Senate confirmed current appointees). • Two members of the fully-confirmed Board are GOP picks, but the Board still has a Democratic majority that may continue to follow prior decisions. • Same-sex marriage ruling in Indiana is on hold, pending appeal. • Gray-area regarding couples married before the Seventh Circuit issued a stay. • Good rule of thumb: Don’t make promises you can’t keep. • Check with the insurer before agreeing to offer benefits.
