ENSURING EFFECTIVE MAORI ORGANISATIONS’ PARTICIPATION IN FISHERIES MANAGEMENT OBLIGATIONS TO MAORI - RESULTS PLAN Fisheries 2030 Goal: New Zealanders maximising benefits from the use of fisheries within environmental limits Goals Fisheries 2030 governance condition: The Treaty Partnership is realised through the Crown and Maori clearly defining their respective rights and responsibilities in terms of governance and management of fisheries resources Fisheries Act interpreted consistent with the provisions of the Treaty of Waitangi (Fisheries Claims) Settlement Act 1992 ; Particular decisions are made in accordance with the principles of the Treaty of Waitangi MFish Obligations MONITORING AND EVALUATION: INDICATORS CURRENTLY UNDER DEVELOPMENT Tangata whenua consultation and Input participation provided for Kaitiakitanga given particular regard in decision making Customary food gathering and special relationship recognised and provided for Historic Treaty settlement obligations met Foreshore and seabed obligations met Commercial obligations delivered Aquaculture pre-commencement space obligations delivered. Settlement delivered consistent with Aquaculture reforms Iwi expect Crown ‘best offer’ in June 09 Overall intent of the Treaty of Waitangi (Fisheries Claims) Settlement Act maintained ; Existing rights of tangata whenua protected and tangata whenua informed on the delivery of their rights Benefits to tangata whenua • Tangata whenua capacity to participate effectively in fisheries management is increased: • Commercial and non commercial objectives integrated • Mechanism to deliver rights under Deed of Settlement clarified • Tangata whenua rights to apply for customary tools are ensured • Minister’s sustainability decisions have regard to input and participation and kaitiakitanga Tangata whenua have access to appropriate foreshore and seabed entitlements Settlement quota distributed to Iwi Tangata whenua have access to new aquaculture space or financial equivalent Deed of Settlement given best effect to by MFish action MFish Outputs • Iwi/Forum Fisheries Plans delivered : • Customary regulations adopted by tangata whenua • Iwi have a clear understanding of the input and participation process • Protocols negotiated that support IFP/FFP input into AOP/NFP • Forums are aligned so that they can be most effective Advice provided Aquaculture settlement delivered TASKS ENSURING EFFECTIVE INPUT AND PARTICIPATION THROUGH FORUM FISHERIES PLANS: SEQUENCE OF TASKS Existing delivery of Input & Participation obligation to tangata whenua New method of delivering Input & Participation / development of performance measures Monitoring delivery of Input & Participation Evaluate effectiveness of Input & Participation Evaluation of existing customary forums/kaitiaki & ongoing access to customary regulations Development of engagement criteria /model of new forums Assessment of new forums / prioritisation of MFish engagement MFish – tangata whenua engagement to develop IFP and FFPs ongoing from this point Satisfaction survey – tangata whenua Stock take of existing rohe moana fisheries plans Development of IFP/FFP strategy Ongoing development of IFP and FFPs Monitoring and evaluation of IOPs and FFPs Input & Participation into AOPs/NFPs INDICATIVE TIMEFRAME FOR DELIVERY REVIEW / DEVELOPMENT PHASE June - July 2010: Treaty Partnership, Fisheries Management, Strategy IMPLEMENTATION / MONITORING & EVALUATION PHASE August 2010 - May 2011: Business Groups: Treaty Partnership, Fisheries Management, Strategy Key: Ongoing process Discrete process 1
