Mr. Eisenstein focuses his practice in life sciences, including patent prosecution, interferences, oppositions, client counseling, transactional matters, due diligence, and patent litigation. He has represented major U.S. research institutions, U.S. companies and foreign corporations in handling interferences before the U.S. Patent and Trademark Office, which have involved personalized medicine, cancer vaccines, angiogenesis modulation, gene therapy, treatment of cancer, diagnostics, medical devices, immune modulation, disease biomarkers, diagnostics, signal transduction and primate lentiviruses. Mr. Eisenstein also has extensive experience in prosecuting biotechnology, medical and chemical cases, and counseling with respect to strategic management of the intellectual property portfolios including due diligence, evaluation of portfolios held by third parties and responses thereto, such as infringement and validity opinions, acquisitions, and strategic use of oppositions. Mr. Eisenstein has been actively involved in patent litigation in federal district courts throughout the United States. Mr. Eisenstein has lectured and written extensively on interferences, oppositions, stem cells, personalized medicine, and living with and successfully managing patent portfolios with respect to changing court precedents, PTO rules and regulations, and patent reform. For example, Mr. Eisenstein spoke at the BIO Annual Meeting in Chicago in 2006 on “Ethical Oppositions,” at the New York Biotech Association’s (NYBA) Annual Meeting in 2007 on “SMART Patenting: Dealing With Interferences and Oppositions in a Global Society,” in 2007 on “Surviving Patent Reform” and at the Association of University and Technology Managers (AUTM) Annual Meeting in San Diego in 2008 on “Global Patenting Issues: Interferences.” Practice • Intellectual Property • Patent & Patent Interferences • Business Education • Georgetown University Law Center, J.D. • Cornell University, B.S.
