112(g) & 112(j) • Rule promulgated later that applies • Comply with rule not source specific determination • If source specific determination more stringent – NDEQ can enforce its determination instead of rule
Residual Risk & Technology Review • EPA to review standards every 8 years • Remaining risk [112(f)] • Second phase • New technology available [112(d)] • Some rules change a lot & others have no changes
