  2. Who Are We? • Departments of Social Services (DSS) • Division of Child Support Enforcement (DCSE)

  3. How it Began • General Assembly session of 1974 provided for the establishment of a statewide support enforcement program within the State Department of Social Services • Title IV of the Social Security Act was amended on 8/1/75 making a Child Support Enforcement Program mandatory on a national level • Support and health care coverage obligations were to be established

  4. Goals and Objectives • Locate absent parents (APs) • Establish paternity • Establish support obligation • Access health care coverage • Ensure through parentage the rights of children upon death of the parent

  5. Who is Referred • Any legal parent, acknowledged or putative father (PF) who is absent from the home for reasons other than death • If the mother of the child was married when the child referred was born, her spouse is the legal father until excluded (201.10 A1a3) • However, if a putative father is named, both the legal and putative father is referred to DCSE (601.2 A1)

  6. Who con’t. • At application or reapplication, the parent/caretaker will be given an opportunity to provide first and last names of all of the men, if applicable, who may be the father of the child -With at least 3 pieces of identifying info • The client must also have explained to them and sign the “Notice of Cooperation and Good Cause”

  7. Communicating • Local DSS communicate to DCSE through the automated 501 series and hard copies when applicable (Medical Assistance only and Foster Care IV-E) • Sends triggers to DCSE to establish a case if not already known to their system • Referral (501) must provide enough information so that DCSE has a “workable case”

  8. Communicating con’t. • Required information is the first and last name of the absent parent and minimally three (3) other identifying pieces of information, i.e. race, date of birth, last known address, social security number, etc. -Exceptions: non-parent caretaker, mental incapacity, undocumented rape and child born prior to 5/1/96 • Remember, the reason for referring is to locate the AP

Establishing Paternity • If paternity has not been established, DCSE will take steps to accomplish the task • Appointments for the PF, custodial parent (CP) and child will be scheduled for DNA tests to be completed • All PFs will be tested, if necessary to establish paternity • If all named men are excluded, the mother will be considered as being “non-cooperative”

  10. What Happens if “Non-Cooperation” is Determined • DCSE will enter information into their automated system, APECS, that will send a trigger to ADAPT that will generate an alert to the EW • The alert is notification that a Cooperation/Non-cooperation Notification form is being sent

  11. Non-cooperation con’t. • Upon receipt of written notification and “Good Cause” does not exist, the 10-day Advanced Notice of Proposed Action (ANPA) will be sent and appropriate penalty imposed • Non-parent caretakers may also be determined to be non-cooperating if information available to them is not provided and for missed appointments or court appearances

  12. Penalties • Penalty will remain imposed until DCSE determines caretaker is cooperating but for a minimum of one month • If assistance has been received for less than 6 months for the child for whom paternity has not been established, the reduction penalty will be imposed • If assistance has been received for 6 months or more for that child, the TANF case will be closed • If paternity has been established, the penalty will be imposed and remain until cooperating but the TANF case will remain open

  13. Penalties con’t. • Effective 10/1/06, if a former TANF recipient who was closed because putative fathers 1 and 2 were excluded, the opportunity will be afforded for the remaining men to be excluded and any other likely potential fathers named at reapplication

  14. Good Cause • Required to be evaluated at time of application or child is added to the assistance unit • Verification to substantiate claim must be provided within 20 days • Physical and/or emotional harm will come to the child or caretaker if paternity or support is pursued • EW makes decision, completes the “Good Cause Communication Form” and sends to DCSE

  15. Support Collected • After TANF approval, all support received is to be redirected to DCSE • If net support collected exceeds the TANF grant amount, ADAPT will automatically suspend the case (SU 013) the first month and will close the case the second month • At the end of the action month suspending the case, a trigger will generate to DCSE the message that the “suspended” TANF case is now non-TANF and support collected during the suspend month will be sent directly to the client

  16. TANF Match Payments (TMP) • Look at the TMP reports monthly and reinstate when appropriate
