  1. remas linking environmental management and performance EMSs - do they perform? Martyn Cheesbrough Policy Manager Environment Agency, United Kingdom www.remas.info

  2. remas linking environmental management and performance Environment Agency • Land quality • Industrial Pollution • Radioactive substances • Waste management • Water quality • Air pollution • Water resources • Flood defence • Fisheries & Recreation • Navigation www.remas.info

  3. remas linking environmental management and performance Industrial regulation • 280,000 industrial inspections • 5,500 enforcement actions • 330,000 samples • 4,000 flood warnings • 11,000 staff www.remas.info

  4. remas A pan-European project that examines the value of environmental management systems in the context of regulation

  5. Who is involved? The Environment Agency Scottish Environment Protection Agency Irish Environmental Protection Agency Institute of Environmental Management & Assessment EU LIFE environment European Environment Agency IMPEL www.remas.info

  6. remas linking environmental management and performance Why bother? • Article 10 of EMAS • Risk based regulation • Confidence in delivery of EMS www.remas.info

  7. Expectations? • EMSs should improve performance - environmental outcomes • EMSs should reduce risk of legal non-compliance • Sites with an EMS should be easier to regulate and lower risk • Non-regulated aspect should also improve

  8. Expectations - EMAS • EMAS systems should: • be more effective • be challenged/tested/stretched • take less regulation • be more consistent • have a base line of legal compliance • Accreditation and certification bodies should take account of stakeholders

  9. remas linking environmental management and performance Recent ‘evidence’ • MEPI study (Sussex University) [1999] • EA OPRA studies (PSI) [2001] • MSWG (UNC) [2002] • IEMA/ENDS [2003] www.remas.info

  10. Experience: Europe - MEPI Study • 270 firms, 430 sites analysed across Europe • No positive relationship between certified EMS and improved performance • Fossil fuel based electricity producers showed negative correlation • source: www.environmental-performance.org.uk University of Sussex (SPRU)

  11. Experience: USA - MSWG and UNC • 83 Facilities in 17 US States • “ These results do not provide support for the proposition that an externally audited, ISO-certified EMS is associated with greater improvements in performance than uncertified facilities” • No statistically significant change in compliance National Database on EMS - mswg/University of North Carolina 2003 http://ndems.cas.unc.edu

  12. Experience:UK EA/Policy Studies Institute • Survey of 843 process industry sites and 2,200 waste sites in England and Wales • Summary: • Link between certified EMS & good procedures; • Enforcement action just as likely at EMS sites; • Waste sites with EMS perform worse than non-EMS waste sites

  13. EMS and Operator Performance

  14. Enforcement Action (IPC)

  15. EMS and Performance (Landfills) (High score is associated with worse performance)

  16. IEMA / ENDS EMS Survey • Survey to examine what EMS practitioners think about: • The effectiveness & value of EMS • The activities of certification bodies/ verifiers • 349 respondents • 63% achieved ISO 14001/ EMAS • 19.5% implementing ISO 14001/ EMAS • 3.5% certifiers/verifiers • 25% consultants
