  1. TRIAL BY JURY RizaSuriben John Catlett The 7th Amendment Rodel Abrigo Lindsay Calhoun 3/24/2010

  2. The 7th Amendment says… “…Where the value in controversy shall exceed twenty dollars, the right of trial by jury shall be preserved, and no fact tried by a jury shall be… re–examined in any Court of the United States…”

  3. What does it mean? • If damages or disputes are worth at least $1500, you deserve a free jury trial. • In the 1700s, 20 dollars was worth more than 20 dollars today. • Once the jury makes their verdict, there are no further cases regarding the dispute.

  4. Court Case Hetzel V. Prince William County, Virginia In this case, A jury awarded $750,000 on Hetzel’s claims against Respondent County but the District court reduced the damages to $500,000. The fourth circuit affirmed the liability finding, but set aside the damages award as grossly excessive and called for a recalculation. After the recalculation the court awarded her $50,000. She filed for a new trial in which she declined the award. She argued that in reducing the damages the fourth circuit had effectively offered her a remittitur which entitled her to a new trial under the seventh amendments guarantee of a jury trial. The fourth circuit granted respondents mandamus petition and stayed the scheduled retrial noting that its prior decision had ordered the court to recalculate the damages “and to enter final judgment thereob.”

  5. Court Case: Curtis V. Loether The women was not allowed to get an apartment for the reason she was African American. During the lawsuit the company countersued.
