Situation of foreign separated children in Europe: an overview • In destination • Seen as a problem • Stigmatisation from general public • States in tension between • Protect children (UNCRC) • Return them back home • No harmonized practice – law in EU • 16 years old = adult procedure (Germany) • Different legal grounds • Asylum • Victim of trafficking • Protection until 18 and then… • Different access to rights - no common protection policy in UE • Education, health, protection • Non adequate care facilities … disappearances • Detention up to 6 months in some countries Verona, 4-5 december 008

Situation of foreign separated children in Europe: an overview • Case of Romania – Bulgaria • National legislation to return them as foreign children • Not returned, not foreign children, but unclear status • EU Parliament Directive • Art 15a: detention of minors without any crime or illegal action except staying in country without entitlement • Detention up to 6 months in case of refusal of return • Priority = fight illegal immigration, not child protection Verona, 4-5 december 008
